Well I messed up.

I had an EPP with CheckSmart. I had made two payments but then Christmas came and I just did not have the money. They deposited the original check I wrote for the full amount. I have overdraft protection on my account so the bank paid the check but now I am $377 in the hole. I don’t have the money to pay for the rent check I mailed yesterday. I am going to have to call my landlord and have him hold the check for two weeks until I get paid again.

At least that loan is paid now but I am really down. It seemed I was just crawling out. I know it is my own fault for not contacting them. I thought I could let one payment slide and make it next week but obviously I was wrong.

I just want other people that have an EPP to know that they may do the same to them if they default. I never thought to put a stop payment on that check. I should have since this has happened once before to me with Advance America but that was different since I did not have a true EPP with them. I am sure CheckSmart thought the check would bounce and it would have if I did not have the overdraft protection.

I called the store and the clerk there did not know anything about it so I have to wait for the manager to come in and see if I get the money back that I have already paid towards the loan.

Well live and learn I guess. That leaves only one more PDL to pay but now this is going to set me back paying them now.

I may not have known for days but I just happened to check my bank account this morning to make sure other things I had paid for had cleared and then proceeded to freak out.

I wish I would never got into this mess. :oops: :cry:


bummer,but as you stated.that loan is paid.now if your landlord can hold the check you should be okay.i hear you about the pdl's.a lot of us if not all of us here wish we never took or heard of pdl's.chin up,things will work out.

Things always seem to work out in the end. Stay focused, you can do this. When the smoke clears you will feel relief that this loan is over and done with. Getting down on yourself will not help anything what is done is done. Sometimes things happen for a reason and we cannot change what is meant to be. Just remember you are not alone we have all been there and I am still working on mine taking one step at a time.

Thanks guys. I do feel a little better now I just got down for a couple hours.

I still have to call my landlord which I don't look forward to doing. I have been behind before and I just got back on track and was making my full rent payments and now this. Oh well. He understood before so hopefully he will now.

I contacted the store and I was told I had to contact corporate. I contacted them and I had to fax in a copy of my statement from online showing that it had cleared.

They are going to deposit my refund directly back to my account. I will still be in the negative but it is probably a good they do it that way so I don't even have my hands on the cash and can not talk myself into not depositing it all back in the bank. At least it was easy and I should see the money in there later today or first thing in the morning.

Edit: I must have been posting while you were posting PDL owner. They are depositing the refund directly to my checking account.

Well my refund was not in my bank this morning like I expected it to be. If he had refunded it yesterday it would show it in there today.

The guy at the corporate asked me to fax over my statement showing that the amount had cleared which I did. Then he called me again stating he needed another statement from that day showing it cleared. I tried to explain that I have overdraft protection. That even though my account is now in the negative that he can see that they got their money, my bank paid it, and now I owe the bank. My statement is going to remain the same, in the negative, everyday until I get paid next week.

I told him twice and he was still not convinced. He said that he has seen the bank turn around and void the transaction back out after they have refunded monies. I tried to explain that is not how overdraft protection works. The bank would not have paid it. It would have just bounced. (Boy I wish that was the case) I mean the statement shows the $575 taken out and the $30 NSF fee right on it.

I told him they got their money. I then faxed him a copy of the front and back of the check. I never heard from him again but my money is not there today.

Now I am worried that they are not going to refund the $287.50 that I paid because the idiot does not understand overdraft protection or can't do math or both. Even with the refund I am still in the hole over $90.

Hopefully it will show up sometime today. If not I am going to call him and ask what is going on.

This was all stressful enough, now I have to worry about getting my refund :(

OMG I just checked my bank again and you will not believe what "Jim" did.

He placed the entire $575 back in the account instead of just the $287.50 that I was due as a refund for the amount I already paid towards my EPP. :shock:

My account is going to be messed even more when he realizes what he has done and takes the money out again and I am socked for another $30 NSF fee.

Now I have to call him and get this straighten out but I will demand that they cover the next $30 NSF fee that I will be charged. In reality he should now just take out $287.50 minus the $30 so I will tell him to withdrawl $257.50 and that makes it even.

You would think that people that handle corporate monies are capable of math. He really must not of understood the overdraft protection.

Geez what a nightmare. Uggg :?

Edit: I have such a mind not to call at all but I know it will bite me later but the little devil in me says to do it anyway...lol :twisted:

Can you believe that I have called this guy three times today and no call back. I left a message each time stating that there was an issue with my refund that was deposited yesterday and he won't return my calls.

Even when you want to make things right they won't work with you.

I have a feeling he realized his error and is going to withdrawl all the money again tomorrow which will tack on another $30 fee. He won't talk to me because He probably knows I am going to demand the $30.

:x I am trying to give money back.

Edit: Now that I think about it can he even take the money back? The withdrawl was using a check I wrote. Can he legally take the money back out? Can he deposit the check twice? He would have to do a ACH withdrawl which I don't think they have the authorization to do.

Well I called the bank and this is rich. They can not post the original check again and they can not do an ACH withdrawl. They can put money in but they can't take it out.

I am sure "Jim" will be calling me again when he finds his mistake. Of course the loan is on the 2008 books. I wonder how long it will take to find???

I sent an email to them via their website just for shits and giggles, here is their response...

I not only faxed it but I faxed it three times and the third time was with a copy of the front and back of the cleared check. I even have the receipts from the fax machine.
