Okay,
Colorado, within sol of 6 years

CA (current assignee and owner) suing me for credit card debt. I want to make them responsible for burden of proof by making them have to produce a document signed by me from the original creditor (BOA) agreeing to the terms of that creditcard agreement.

Question 1: If I was approved for this credit card by filling out application online, (electronically signed via internet) what exactly do they have to provide to be considered legal proof that the account is mine? Is it some kind of paper document that has my electronic signature?

Also, I did have a credit card account with BOA but the account number in the complaint (stated to be credit account number originally held by BOA) is COMPLETELY different from the one shown on my cc statements received from BOA. I also checked my credit report and the account number on there is only slightly different than the one stated in the complaint.

Question 2: Which account number do they have to use as burden of proof?


Okay! I found the Uniform Electronic Filing Act (UETA) that was adopted by colorado in 2002. There is alot of information in here about electronic signatures. I am having trouble locating the information I need for how electronic signatures must be presented as legal evidence for burden of proof. Does anybody have any experience in dealing with electronic signatures being used in original credit agreements?
