To pay or not to pay

I live in CA and have a few internet payday loans. I'm finding through this forum that all 3 are illegal and out of country businesses. My questions:

1. Can I legally get away with not paying them. Note, I'm not looking for a moral answer, I know I should pay the amount borrowed but just wondering if I legally don't have to? WHY - becuase it appears by this site they have illegally taken advantage of many and don't deserve to be compensated for thier unfair, cruel and harrasiing tactics.

2. Why do they say they are one company name but ask you to pay another name yet say they are not 3rd party collections?

3. If I ask for a copy of the contract and a physical address and they refuse then can I refuse to pay them?

4. If they are illegal and out of state can they still report a default to the credit agencies.

5. If they call me at work and claim to not be a 3rd party collection company then how can I get them to stop. I mention the FDCA and they say it doesn't apply.

6. What steps can I take when they refuse to answer my questions to verify who they are and they refuse to give the information? I'm afraid that if I pay via bank, debit card or anything other then money order, it won't stop them. I'm very afraid of giving out my personal information now.

I want to pay but they are unwilling to accept anything less then what they want.


sorry but this may be a moral answer. Would you borrow money from a friend or family member and not pay back what you borrowed because they are not licensed to lend in your state?

Have they taken any fees from your checking account?

Have you talked to your state or filed any claims with your state about these lenders?

What you need to do is list the companies you borrowed from and how much you paid back and we can help you. Have you defaulted on these loans?

I agree. If I were Melissa I would definately pay back the principal borrowed Illegal or not. I just would simply negotiate a fair repayment on MY terms that is affordable and reasonable. If they refuse then that leaves you with the advantage that they do not want. Just document everything. I too had PDLs that didnt comply with me. I never paid them, but I did keep track of all communication and their refusal to accept my payment in forms other than ACH. They are out $50 from me because they were stubborn :)

Thanks for the information. I have sent them a taylored letter you have in your samples requesting physical address/location, lisence #, etc.. I also put in the letter the CA information for loans. They didn't like that very much one of the companies responded and said they did reseach on me and found I was still applying for loans which is incorrect since I have no bank now. They assume that I intentionally got a loan with no intention of paying which wasn't the case. It was only after thier threatening calls that I started doing my research. How can you stop them from inquiring into your credit?

They are not doing a credit inquiry, they are most likely running your name in the TELETRACK. Once you apply for a PDL most companies can run your information in Teletrak. On the contrary, it seems like they are blowing alot of hot air if you have not applied for any further loans. PDL companies can report you to Teletrak if you default or have any derrogatory information with a company. I suggest you request a copy of your Teletrak report for free.
