I was just sitting here wondering if I'll be committing some kind of a crime if I take my answer to the summons and sign it in front of a notary.

The summons is in my premarried name. I do still have a valid photo ID in that name, but can I legally sign my previous last name?

Would that be considered some kind of fraud?

Even though MO is a state that protects joint assets from collectors (except for medical and taxes), I really don't want this collection agency to know that I'm married.

This JDB has also purchased, or been assigned 3 more of my premarital credit card debt.
The SOLs on the rest of my credit cards will expire in 2010.
That's not that long from now.


I guess what I do will all depend on if I legally have to disclose my married name.

If I do, then I'll probably just let them get their judgment.

I'm only considering that because my dad passed away a couple of years ago and left my little sister and myself some property that it tied up in a land contract.
Within the next year, we will be selling this land contract to one of our relatives. I will then have the money to have the lien removed (should they get a judgment and put one on my vehicle.)

Should I risk them putting a lien on my truck? or should I send the JDBs attorney a letter telling them that I would be willing to make $50 payments if they will drop this suit?????

Someone told me that I would come across as weak if I made them an offer before discovery......

If I'm going to file my written answer, I have to do it within a week.
If I'll be committing some kind of "real" crime by signing my previous name, then I'm not going to sign it....I'm also not going to disclose my married name to this debt collector.

I might reapply to legal aid to get help with filing bankruptcy. They turned my case down, because they don't deal with collections/garnishments/etc.

If they'll take my case and let me file bankruptcy on my premarital debt, then the judgment would be included. Plus all other possible lawsuits would be stopped before they started.
