They probably won't send it to you and will still harrass you. The next step is to send them a cease and desist letter.

I received a call from ACH Credit Recovery Systems today as well. They were trying to collect on money that I borrowed from Advance America 4 years ago. I lived in California at the time and took on a lot of debt. As a result of that debt I moved cross country to live with family and get myself back on my feet. I setup payment plans and paid off all my other debts. Now, out of nowhere 4 years later I get a call from ACH saying I owe $490 for my Advance America account.
Like kfstaff24 I tried to do some research on the company and was able to find very little. What I did find was lots of mixed reviews. The man that I spoke with seemed unprofessional and evasive in answering my questions. I sincerely told him that I accepted the debt and that I was just questioning the legitimacy of the company before I began making payments. He told me a wishy-washy story about how they don't have a website right now because it is under maintenance but he could send me an e-mail or certified letter providing me with more information. I have no problem disputing the case by sending them a letter and by checking to see if they are licensed to collect in my state (Illinois) but I don't want them harassing my employer and family for weeks while that goes on. Any suggestions?

Did the person that you spoke with say where they were calling from? Have you check with the State of Illinois to determine if ACH Credit Recovery Systems is licensed to collect in IL?

I would ask this company to provide information regarding thier ability to collect debt in Illinois. You can ask for a debt validation, but if they were hired by AA this would be no problem for them to get. Again, the big concern here is that they do not appear to be licensed in IL.

You should check to see what the statute of limitations is in your state for debt collections. Based on that letter, your debt is more than 4 years old and it may be impossible for them to legally collect from you. If the SOL has expired, you should send these guys a certified letter telling them so, and also telling them to cease all contact with you. Good luck.

They can still attempt to collect and it will remain on your credit report as unpaid.

Sure, but attempt how? If they follow the law, they can't contact the debtor if (s)he tells them not to. They can't sue if its outside the SOL (well, technically they could try but they are guaranteed to lose if the debtor responds, so why bother?) and I think a case could be made that the agency violates the FDCPA if they try to take an action (file suit) - or even threaten to - that they know they legally can't prevail in.

We are investigating them also. They have quoted some of our personal information which has caused us to take action. They call their business ACH Credit Recovery Services, we believe that ACH stands for Automated Clearing House which for one it appears is a way money can be added to or taken from your bank accounts, example-some of our government offices use ACH. I received a call ACH Credit Recovery Services in CA about a debt I apparently failed to pay 10 years ago! I now have excellent credit (780), a new house, a new car, and a full-time management job. I was only 21 10 years ago. Can they legally do this? I have no recollection of this debt at all! If it was on my credit report it would have been off 3 years ago.

It's way past the SOL, I would check my credit report if I were you. If it is on there, dispute it on the grounds it is past the SOL.

Remind them this debt is past the SOL, BUT, if they insist on making a fool of themselves and try to collect then you are going to see to it that they follow the FDCPA, sooooooooooooo, since they called yesterday, tell them they now have 5 days to send you a dunning letter (letter of collection) thru the mail as required by the FDCPA, until then, you will not discuss alleged debts over the telephone.

I got a call from a guy selling some kind of investing info so was looking online to find out if he was part of a legit investment company and stumbled upon this site. I am shocked that there is a site where you deadbeats get together and coach each other on the loopholes of getting out of paying your bills! It is people like you that create the NEED for the very companies like the ones you cry about to exsist! To the people on here that coach these people - get a life. To the deadbeats that are blogging and sharing notes on the in's & outs of slipping off the hook for your debt - your the reason honest, hard working people like myself who pay my BILLS are repulsed to see this site and listen to you all whining about your rights. I have read several threads on this site and God knows why I am wasting my time writing this but the debt collection agencies, or attorney's who sue people for not paying their creditors or any person calling you for the money you owe is not the problem with society. You are! Keep crying to one another, I hope these debt collectors call you night and day, mail things to you, sue you & garnish your welfare checks. So go on, Keep borrowing more than you can ever pay back, keep taking so much you can't even remember the debts, keep trying to figure out if the state you reside in is a good enough technicality for not paying a bill. I'm sure the time your spending doing that will get you all out of your 2 bedroom rental trailers and possibly you will pick up enough on these sites to possibly earn a G.E.D or worst - more tricks of the trade on how to scam for more credit than you deserve.
