motion to set aside judgment forms
Date: Fri, 01/16/2009 - 20:26
Does anyone know where I can get the necessary forms for filing a motion to set aside a default judgment in Indiana? I've done a couple searches on the internet but have come up empty handed. I found one for Utah that was really good but not for indiana. Does anyone know if they would be the same?
Thanks a bunch!

I beleive you mean a Motion to Vacate? Have you referered to your local Rules of Civil Procedure? You should also be able to go down to the courthouse to acquire the proper forms. Make sure your MTV complies with RCP.

Many times they just have a blanket "motion" form, and you have to come up with your own legalese to motion the court what you want it to do.
I know that my county (Cook, which is one of the largest in the country) doesn't have a specific "Motion to Vacate" form. If I wanted to file such a motion, I would have to use the "generic" motion form.

The court clerk should have the forms (if available). Some courts don't actually provide pre-printed forms - they leave it up to the litigants to type it up themselves. That's when you have to read the Rules of Civil Procedure with a fine-tooth comb, to make sure your document complies with court policy.
If need be, you can click below for a few sample forms (link to Cook County Website [government links allowed per TOS]):

This has been really helpful, thank you!! I completely read through the ROCP document for my state but didn't really see anything specific like margins, font size or font type. I'm tempted to try to see what happens. I guess the worst case is they don't accept it or the judge throws it out.

Sometimes it's not in the statutes, sometimes it's buried in "administrative orders" or such issued by the court itself.
You should be fine if you double-space it and use 10 or 12 pt font. If the clerk doesn't have forms, you can ask them what the rules are for typing it yourself.
