Collection agency is threatening to garnish wages

7 years ago I went through a debt consolidation company to have my debts paid. Even though I paid them thousands of dollars, they never paid off my debts, so for the last 7 years I have been paying those debts for a second time. Now I have another collection agency telling me that if I don't pay this debt (which supposedly had already been paid), they will garnish my wages. It has been 7 or more years. Is there anything I can do to stop this?


which CA is threatening this?they would need a court order to garnish wages.which would mean a court date and them being awarded a judgement against you.if you could either provide the name of said CA or a ph#that comes up on caller id we can help you.

Do you have any type of paperwork on the paid debt? Also ask for a validation of debt; which if you're not sure what that means, it's proof that the collection company owns the debt or has been assigned the debt. It's pretty hard to obtain a judgment/garnishment on their part if there's no direct contract between original creditor and collector.

a creditor called and said that i owe $1500 for a credit card from 2001. they are now calling me and threatening to garnish my wages. can you give me info on this? arent there statues of limitations? i live in PA

I wouldnt even worry about statute of limitations--they are flat-out lying to you because in your state wage garnishments are NOT ALLOWED for consumer debts. They are full of BS.....and what you need to do is record the next phone call with them. Get them on tape saying that they will garnish your wages, and do NOT tell them that they cannot do so in PA....just let them speak. Let them hang themselves with their illegal threats.....then, go to the NACA dot net website and find an attorney so you can sue these scumbags for breaking federal laws.

As an aside, statute of limitations does not mean they cannot call you and try to collect after that has expired. It means that if they sue you after the SOL has run out, your answer to the summons would be that the case must be dismissed due to expired SOL. The case would go away that quickly in that case.

A CA company RKS financial is calling me harrasing me about a "educational loan" that my exwife defaulted on over 10 years ago. I have not heard anything for 10 years about any of this. These guys are real butts. First Question..Can they do this after 10 years? Bankruptcy was filed by her 10 years ago...I find it very odd after 10 years calls are suddenly coming in. They won't mail me the information. They say they will only fax it and are threatening me with garnishment...This isnt even my loan, but my name mysteriously appeared on it.

A collection agency called and threatened to garnish my wages and my husband's wages for a $1400 medical bill if I didn't pay the full amount in 90 days. They also threatened to put a lean against my house. Can they do this? After researching site in Nebraska I'm reading companies can garnish 25% of my earnings. This would bankrupt me. I offered to make $30/monthly payments and they refused saying I did not give them any other options

Do they have a judgment against you?

There is no SOL on federal loans and it is quite possible that she didnt meet the requirements for a bankruptcy 10 years ago on a federal one.

Did you cosign? Who is the loan owed to?
