Update w/ Credit Union with all the payday loans

Anyway once I went back to DFI with the letters, and copy of the Electonric Fair Debit Collection act,they went back to the bank. Well the bank is just now getting around to it even though DFI gave them to December 31st to answer. At first the bank said they would waive 532 dollars from after the fourth, and said I would still owe 945 instead of 1500. I said nope. I have a collection letter here from you for 744. Faxed him that yesterday afternoon... and said took 532 off that amount since we couldn't figure out where the 744 came from since it didn't match my statements from June 2007 anywhere. So now, I only owe ligitmately 212(which sounds about right and from what I can add from my statements). I'll be doing 100 each paycheck, then the bank will delete the mark off my Chexsystems report.
So my advice, don't take no for an answer. DFI's orginal response was "we can't do anything, you have to go back to the payday lenders" yeah fat chance of them doing anything. In fact I fild a seperate insidence with Check N'go that DFI is still working on and trying to get solved. Check N'go is instant that since I signed a contract it basically gave them the right to go into my account whenever they wanted, even though WI law clearly states they can only debit twice.
Also save everything, letters, responses etc. You never know when you may need to get a lawyer involved. In fact I did get a lawyer but I was in the process of getting all the items he wanted when the bank decided to play nice, so I'll have to call him today and cancle my claim.

I actually didn't even t hreaten a lawyer.. though I did contact my States AG and told them I wanted charges issued against the Credit Union, i'm sure that's what got DFI to re-open the case. :) I'm just glad to have this over. Now to get Check'n go to play nice with Dfi.. but that's a whole nother rant.
Last I heard on that one (which was Wed) they sent it to the Division of Banking who is still reviewing the practice of multi-debiting. Until she hear from the Division, she won't know exactly what concerns they may raise on that issue. But she will notify me when she knows

Good, Checkngo looks and acts all professional but they are shady little devils in disguise. You saw on my post that I reported them today. CFSA has already confirmed they recieved my complaint and that it appears to be valid.

I specifically asked the rep if that just because I signed a contract that it trumps the law and she said it didn't. I requested they go back to them. They didn't give me the rebutal letter but needless to say that since Dfi sent it to Division of Banking that Check N go did break some law.. they're just trying to figure out which one.

Other Terms: You authorize us or our financial institution to debit your Account through an Automated Clearing House ("ACH") debit at any time on or after the Loan due date for the Total of Payments. If there are insufficient funds in your Account on the day we debit your Account, a $ 29.00 fee for insufficient funds will be charged by us and debited from your Account by the Broker. If we must send your Loan to a collection agency, you agree to pay any collection fees and reasonable attorney fees and other costs to collect the Loan.

We may re-initiate a debt entry up to two times if your bank returns the entry due to insufficant funds. Yet their letter to DFI States:
Section... "You authorize us and our agents to intiate one or more debit entries to your bank account in order to collect the total of paymentsz plus any default penalities you may owe under this agreement. "We attempted to collect this debt on June 29th, 200y via three Ach debits... on July 12th we attempted to collect this debt a final time via three ach debits.
Umm hello dumb shits, you just violated your own contract :P Not to mention I revoked their authorization back in May 15th. DFI is probably pulling their hair out on this one.
