So I recieved this email that I thought it was kind of funny. Not only is it a settlement offer on a $200 loan but they want to do my income tax returns. Hmmmm...I do not think so.

Little do these idiots know what they are in for:

1. If they have offices in CA, OR or MD their preparers had better be licensed, EA's or CPA's.

2. Since they are taking compensation from the tax refund (payment of a debt) they are "Paid Preparers" under Circular 230 and are subject to all the privacy, nondisclosure and due diligence requirements of Circular 230.

3. In the past 2 years the IRS increased both the amount and number of penalties a paid preparer is subject to, If they pay as much attention to Circular 230 as they do to FDCPA they will have a LOT of IRS problems in a couple of years.

4. If they will be electronically filing the returns then there is human being somewhere who will be personally responsible to the IRS for all the requirements of Pub 1345, including the requirement that no part of the return information be shared with the collection floor at any time without prior written consent of the taxpayer.

5. And just who will be representing the taxpayer in the (very likely) even of an audit?Huh?

6. I presume they will be taking their payment from the debtor/taxpayer's refund? There are only two ways to do this - to have the taxpayer get a Refund Anticipation Loan (and neglect to tell the lending bank that the loan is being originated by a COLLECTION AGENCY) or to have the refund paid into their account, subtract the settlement amount and forward the rest to the taxpayer (a blatant Circular 230 violation). Either way, this scheme is of dubious legality.
