My mom opened an ATT account in my name!

This was 7 years ago and I have been getting harrassed by Asset debt collection for about 3 years now about it. They said they bought my info from ATT, so I called ATT and they dont even keep records for more than 2 years so they knew nothing about this "bill". Asset collectors are threatening to garnish my tax returns and ruin my credit for 7 years if I dont pay them $500!. How can they do this if the account was fraudulent in the first place? Wouldnt that be ATT's fault for using my info to open an account when it wasnt me in the first place? Also they suggest I press charges on my own mother which I am in no way willing to do. How can I get these jerks to leave me alone? and are threats real?


Check your state's SOL (statute of limitations) if it is 7 years old they can't legally sue (they can try, but you claim SOL)..plus it may also be unable to put on your credit report because a debt can only be listed for 7 years.

If it is beyond your SOL then send them a total cease & desist and tell them to take a flying leap.

Have you ever gotten a letter from them? You should have gotten one 5 days after first contact. If not, simply tell them that you will not speak to them until they send something in writting. If their phone number comes up on claller ID, simply ingore it. collection agencies can not garnish wages, only Collection Attornies.

Secondigly have you gotten a copy of your credit report? If not, would be a good idea to get one and see if they reported it to your credit. If they have dispute it with the agencies.

i would look at your state SOL.if this is not past,then send the DV letters.i don't know what the protocol is on ID theft.7 years is long time.i'm hoping nascar can clarify this.
