Bank Account Garnished-Help!

Hello,
First post here. At the beginning of my weekend it seems a creditor garnished my bank account for nearly $4000. I only had $70 in the account so it went negative. I have an idea who it is but received no notice about this at all. I was making monthly payments to a Capital One lawyers office and the $200 a month was overwhelming so i was behind one month. It's now Sunday and I can't do anything until Monday. I will cancel my direct deposit first thing in the morning then try to contact the creditor. I have no money for food or gasoline until this is resolved. Anyone else go through this? Any advice would be greatly apprecited.

A creditor cannot garnish your bank account unless they bring judgment against you to do so. What I think is that, you should first pull out your credit report and see whether there is any judgment. If there is no such listing, you should call up the bank and check the name of the company that has debited your account. If the debit is illegally made, you can ask the company to repay it back and if they do not agree to do so, file a complaint against them with the FTC.

Very good advice from istncredit. This may just be an illegal ach withdrawal or idenity theft. It is possible for an attorney to get a judgemant to put a lien on your account without you getting a notice. It happened to me once. I sent a check as a payment and they used my routing number and account number and cleaned my account out. They did have a judgement that was given instantly to them by a judge buddy! This was when I lived in NJ. It never showed on my credit report either.
