I am sorry I don't know anything on how the new laws work in Ohio.
The last loan I had from them was under the old law.
I think the one thing you can do is to revoke the ACH transaction. You are allowed to legally do that three days before the transaction is due. I would submit that to your bank as well as to the CheckSmart corporate office and the store front.
I would also include a wage revocation as well.
You need to submit something like this but with your own information and loan company info.
Quote:
I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected. |

btw, checksmart is a member of CFSA. Not sure what they can do for you though now that you have defaulted and are in collections, but they may be able to help. Doesnt' hurt to call and ask what your options are.

Checksmart is tuff to deal with. I had the same problem. I ended up letting all non essential bills go until I paid them off. They will take you to court. Even if you can take 100 a payday in, they will take it, they say they won't but they will. Just find the money and pay them off ASAP...Reny
