I had a payday loan with checksmart in ohio that was due 12/15. I was not able to pay it. the loan was for $800, with fees $912.00 all together. In the contract, (because payday loans are done differently now) it stated that if the balance was not paid after 10 days being past due that an additional fee would be charged to the balance, (which it was), and ten of couorse there was the return fee that was charged as well. so the collections dept kept calling me several times a day of course i did not answer because i knew why they were calling and i didnt have the money yet. Ii ghad switched jobs and with the hollidays coming up at that time i did not have the money. finally after about 2 weeks aropund the beginning of january i called just to get them off my back and told them that i would be into the store to pay it that week, well i had to make an emergency trip to the dentist(which cost extra money that i did not have set aside for) (and i missed work because of it, so i lost money there). so to make a long story shorter...i did not go in and pay. of course they called again, i told them that something had come up and i did not have the money i would be in on my next payday to pay it. Next payday came around, i did not have the money. they called me the next day and said that they were tired of my broken promises and that if i did not go into the store the next day by a certain time and pay it then on the following business day ...monday 1/19 they would be contacting my employer to get the money some other way.(however they do not know who my employer is now because i changed jobs). The rep even said on my message that he doubted i would even call them back anyway. well i di call that jerk back, he aske me why did i say i would be in to pay if i did not have the money, i told him i'm sorry that i only had some of it and i know they will not accept partial payments so i did not go in to pay it. i also asked about another thing in my contract that stated if the balance remains unpaid for 30 days that they will begin to debit my account in 4 equal payments totalling the full amount due from my bank account on each payday, so i akse about that because THAT i could afford, and all he said was that they can debit my account anytime they want. He asked me how much money i had, and i told him i had $500 (my balance with them was approx $1004.00 at this time) and he said i'll tell you what, if you go and pay that $500 to the store by sunday the 18th at 5pm then you can call me the next day and i will make arrangements wth you for the rest, because i don''t believe that you really even have $500 right now anyway! so next day on my way to work i went to checksmart to give them my $500 (which was all the money i had) and they were not even open yet, i called and spoke with someone else there and they said "as long as you go into the store on monday(the next day 1/19) and pay the $500 then i'll give you until the 31st for the rest" so i went and paid that as i said but i still owe approximately $504 of which i now have only 6 days to come with an extra $504 and i do not think i will have it. what should i do. If it states in my contract that they will debit my account in 4 equal payments on each payday for the remainder, do they have to do that or not? i just know that i will not have it because i have insurance/car payment/cell phone/and rent coming up and they are more of a priority then this loan. Does anyone know what will happen? by 1/31 my loan will have been late by 1 1/2 months.


I am sorry I don't know anything on how the new laws work in Ohio.

The last loan I had from them was under the old law.

I think the one thing you can do is to revoke the ACH transaction. You are allowed to legally do that three days before the transaction is due. I would submit that to your bank as well as to the CheckSmart corporate office and the store front.

I would also include a wage revocation as well.

You need to submit something like this but with your own information and loan company info.

Checksmart is tuff to deal with. I had the same problem. I ended up letting all non essential bills go until I paid them off. They will take you to court. Even if you can take 100 a payday in, they will take it, they say they won't but they will. Just find the money and pay them off ASAP...Reny
