Call from PDL Yes today, small claims court?

I got a call stating that he received a message stating that I refused to pay the amount owed (per them) for a PDL. I did not refuse to pay, I stated I would pay principal and only via money order, they refuse to do this.

This guy who called today left me a message saying it was getting ready to be turned over for small claims court and if I wanted to deal with that? He asked me to call him and let him know what "my beef" was with the company.

Will they do a small claims court?


I've NEVER heard of Payday Yes actually following through with their threats, in my opinion, it's only a threat. A judge would probably laugh them out of court as they are not licensed to lend. All you would need to do is request a copy of their license in court, they wouldn't be able to produce one and it would be thrown out, BUT, I doubt it will ever get that far.

right on nohiogal.you sent letters to this bunch of idiots.they are as stupid as they are illegal.do not play there game,instead look into perhaps taking them to court for violating a C&D letter.

Easy there friend.

All that I was meaning was that she agreed to terms and did not keep them the first time. Once she sends the letters from here, give them her terms and make sure that she sticks with them. If she sticks to the terms that SHE set forth, they will have no reason to bother her.

i got your meaning.when dealing with an illegal loan company any word given goes out the window.like giving this bottomfeeder ACH access.if they are unwiiling towork with the consumer and threaten.then they really should if the balance is low enough.just work with us or forget bout it.by the way this pdl got slammed in illinois for these same tactics.says it all don't you think?to both of you defending pdl's makes you a troll.if i got the wrong mesage then my apologies,but i don't think i did.

How am I defending this illegal PDL?

a. Stated that C&D doesn't mean anything to a 1st party collector.

b. Advised OP to send necessary documentation about them being illegal.

c. Set her terms for repayment.

d. Stick to the terms that SHE set forth.

This is the process that you and others on here state to follow. Correct?

she shouldn't send anything until the illegal pdl at least agrees to it.that is my point.why send payments when they won't accept her terms.never send anything until agreed on in writing.can we agree on that at least?

great!!!!!!!!!!just know that i had dealings with this pdl and they will never admit to being illegal.i tried the letters and it didn't work.they are just going to have to be fined again bfore they listen to reason.
