Waiting on my tax refund to come in on Friday so I can't close the account. Just talked to someone at the bank about putting a freeze on the account and allow for deposits only. The banks said if this is done they will return any and all debits that come through no matter what the amount. I even asked the bank if they could link my tax refund deposit to my new account but they said they can't do that.....that doesn't make sense to me.

If you are wanting to block PDL's that are not following the laws of your state, you need to contact BOA Ach Dispute area. They will take the information about each debit and investigate your claim. You are required to fill out an affidavit. BOA worked with me and returned the overpayments to my account within 14 days. So far so good.

BOA will work with you if the PDL's are using illigal activity for your state laws. You need to contact the ACH Dispute Department at BOA. There is no charge because you are not putting on a stop pay, you are claiming fraud and asking them to investigate. You will be required to fill out an affidavit stating what happened and how much you feel you were improperly debited.
This process took about 2 weeks for me and my overpayment was returned to my account in addition to 2 nsf fees that were incurred due to the PDL debit that I hadnt even asked about! I thought they were very nice and helpful at BOA.

Thank you and I'm in the process of doing that now with Speedy Payday as they have overcharged me tremendously. The bank can only look at the past 60 days but it is $540 so I feel certain that I will get those fees back. I live in NC and they are completely prohibited in my state. I'm concerned because one of the pdl's I haven't made a payment on yet. I'm in the process of going with Langhorne and they advised me to close my account but as I said, I can't do that until my tax refund goes through. I did open another account and managed to get my direct deposit to go into the new account. My account that the pdl's will try to debit is at a zero balance right now and I'm afraid if they try to debit I will go into a negative balance and then it will eat at my tax refund. Hopefully if that happens I can file a claim and get my money back.

BOA just called me and told me that they have a hard hold on my account and there is no way anything can come out. That was good news. They said when my tax refund comes in that they will have to release the hold on my account before I can access the funds. That works for me. At least I know these voltures won't take my money anymore!!!!! I think I will sleep much better tonight after receiving that call. The woman at the bank was very helpful.

I also opened up another account and was able to change my payroll direct deposit, which goes in tonight but couldn't change the irs refund. They told me a the bank that my refund will go into my account but the funds from my refund can't even be released until the hold is removed from my account and they I can transfer the irs funds into my new account and close the old one for good!!! I'm not trying to ditch my obligation in paying on my pdl's but some of them I've way overpaid. I got myself into this mess and I need to get myself out, whatever it takes. Thank you. It's been 2 days since the block and the pdl's were all returned unpaid and no service fee from the bank. I haven't received any phone calls yet but I'm sure my phone will be ringing tomorrow. Hopefully my tax refund will be in the bank on Friday so I can close the account and not have to worry about them going back in it. The block does work, at least at BofA it seems to work.

When it was returned unpaid did it still show up in the red when you accessed your account online? Mine did.. I woke up this morning and it said -700.. but then an hour later it was -1400 and it said ACH check hold for 700 which I'm assuming is the bank returning the debit. I went to the bank to make sure everything was ok and the branch manager that has been working with me on this assured me everything is fine and not to worry.. the account is closed and nothing will go through. I just didn't understand why it was showing negative online.

I also put a stop payment fee ahead of time on all of the pdl's just to be extra cautious. Someone I spoke with in customer service with BOA didn't charge me the stop payment fees so it all worked out well. I had hoped to close my account by now but the IRS has been so slow with refunds that I had to keep it open for my check. Well, H&R Block sent the refund to the bank yesterday but it's not showing up yet.....the bank said Monday morning. I hope so I'm ready to close the account. The lenders have not tried to debit anything else out of my account, which surprises me. I sent letters to all of them and haven't heard ONE word. They are all illegal and I also live in NC where they are prohibited so I'm sure they will take their time.

Sorry to hear about all the problems with BOA. Two PDL's tried to debit my account before I was able to place the hard debit block. I filed a claim with the Fraud Unit and they placed the block and returned both debits. Since it takes about 6 weeks for my payroll department to switch accounts for direct deposit, I have to call BOA every payday to release my funds and then they replace the block. So far, so good. Once my direct deposit is changed, I will close the account.

Yep can you believe that? I closed my account in October and it just finally closed last week. I had a direct deposit that I changed to another bank show up in my BofA account and it reopened. I had to physically go to the bank and withdraw the money, thank goodness there wer no debits

It can take my work two paychecks for the cycle to actually go to the new account. But I do get live checks when I change my account. This is actually automatic where I work. (if you change accounts you are given live checks until the direct deposit takes effect)

I just got off the phone with BOA and they put a hard hold on two of my pdl's. She did inform me that it won't be in affect until friday or monday and the 2 pdl's can continue to keep trying. I'm so in the red at BOA but she told me that if I go into a branch and make some sort of payments to them, they will note that on my account. Once I get it back to 0.00 I can then close it. So we will see... This has driven me soo crazy! I have totally learned, now I don't know what to do with the illegal 2 pdl's that will call and demand their money... what can I do now? any advise
