OK. But Michigan is also one of the 17 states that requires a written acknowledegemnt of the debt and a written promise to pay in order for SOL to reset. When was the case filed? If they filed prior to 9/27/08, then SOL would have tolled pending the outcome of the case.

I have this debt collector that is an attorney he sends letters stating he was contacted by who the origanal debtor is then proceeds to take me to court. He first recieved a judgement in 2002 for 1600.00 he then charged me interest and filing fees garnished me 1400.00 and when was all said and done I paid almost 3000.00 in to this guy in april of 2008. In May of 2008 he claims to be contacted by another debtor and now recived a judgment this debt was from 2002 and he is now reporting on my credit reports and making it look like that payments or contact was made so they don't go past the statue of limitations is this possible or even legal to do?
