Hello All Fellow Bloggers!

As we all have fell on hard times at one time or another; I too chose to the PDL and thought that 1 won't hurt and then 1 led to 3 and several more!! I had no clue that these companies were or could be operating illegally!! I am in TN and here is a list of my PDLs:

Cash Direct Express powered by GECC Bal 113.85
PayDayOne Bal 1089.00 Rolled Over
Upfront Payday Bal 585.00
US Fast Cash Bal 390.00
Huskhawk Group Bal 390.00 Paid 90 in fees

I of course have processed these all thru the internet. I have been reading the threads about closing accounts, etc. I have two accounts that I have had for quite some time. However if in TN it is legal to close and reopen; I am willing to do this to stop the madness.

I also had a problem with a FREE TRIAL and have had no success in cancellation of this free trial so I had already thought about closing my account. The bank placed a stop payment on the charge and the company used another "name" to get around the charge!!!!

Please comment with suggestions and how to proceed from here!! Thanks so much for your time and efforts! I know that I have learned my lesson!!!

You can CLICK HERE to look up your laws. Some of yours aren't legal lenders in your state, another thing I would like to point out is TN allows an Internet based payday loan company to lend legally as long as it is licensed in any US State. They would need to follow the laws of the state they are licensed out of, not the state the consumer is in.

You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)[/quote]

Payday One is legal, I'm not possitive but I don't think Hushhawk is legal, you can type the name of the company into the search box which is located in the upper right hand corner of this forum, that will bring up some information, then you will need to read through some of them and see what you can find out about them.
I'm not sure about the other two- SDS and CMG, what does that stand for?

I am not sure what they stand for. Is there a way to keep Pay Day One from drafting since I will be closing my account. How will I handle the legal ones?

You will need to make some type of payment arrangements with the legal lenders, perhaps someone else will know something about the other two and have some advice for you, about them. If you are closing out your account there is no way ANY lender (legal or not) can debit your account, and that's a good thing. Just ask Payday one if you can send payments (by money order) through the USPS. I wouldn't give out my new account number to ANY of the lenders, pay them all by USPS, with money orders.

Hey guys,
Went today and closed both accounts and feel a big relief from that! The banks were very accommodating. Now to get the letters sent to the PDLs. Should I call them or just fax the letter to them with the ones that I have fax numbers to? Thanks again for the help!

You need to send them a letter stating they are illegal and that you are only willing to pay the principle of the loan.

Here is a sample letter. You need to tailor it to your own needs, personal information and loan information.

The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S.. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.

I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the ____ Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

You can fax, email or send certified USPS or all three. I only emailed mine.

For PayDay One you can send them just the ACH and wage assignement revocation part of the letter.

You can email it to them. They are really easy to work with and their customer service people are the nicest you will ever deal with. They do accept payment arraingments.
