Can they really do this??? I'm trying to save money for a lawyer before filing BK and have been avoiding collection calls in the mean time. Now that they are bugging my parents, who I do not want to know I'm in so deep, I need to do something. If a pay an attorney a retainer, will they continue calling or can I refer them to my attorney? How long does it normally take once it goes to collections, before they will file suit? This is becoming far too stressful.

as long as they don't disclose anything they can call to get contact info.once they know your contact info.they shouldn't call them again.

However, once you do pay your attorney a retainer, then you can refer all your creditors and collection agencies to him/her. The attorney should start dealing with them at that point.

If they call, you just give them the name and number of your attorney and that's it. You don't have to say anything more to them.

I might suggest being proactive; however, and contacting the OC's/CA's that are calling the third parties and tell them to stop. If they have your correct contact information, the only reason they are calling third parties is to attempt to shame and embarrass you. You can nip that in the bud before it gets out of hand.

I'm sure the third parties getting calls regarding you would be grateful too. It's been my experience that OC's/CA's will harass third parties as bad, or worse, than the debtor.
