Regular harassments from the Collection agencies

I am getting these harassing calls from the collection agencies at all times of day and night. Please suggest me ways of how I can stop them from contacting me.

There are some specific federal laws that need to be followed by a debt collector before making collection attempts. Please have a look at the following page that states the various fdcpa laws and these are required to be followed by the debt collection agencies.

Write a letter to the collection agency stating the fact that you refuse to be contacted except to notify you about any legal actions that will be taken or that the collection efforts have come to an end. Send your letter through certified mail with return receipt requested. This will keep a track of all the correspondence done on the specified dates.

one more thing... do you even owe a debt to them? if so, just work on paying it off. the reason they may be contacting you is because you OWE $!!!!! it is their job to call and collect the money you owe. it's not 'harassment' it's 'business'

There are issues over here when some CAs calls a wrong person who does not owe at all. After informing them that they are contacting the wrong person and explaining the matter in writing, they do not stop their actions. Please suggest from your experience what should be done at this point.

Ben, once a collector has been advsied they have a wrong #, that person is to mark the # as such, so that it will NOT be called again for any reason. it doesn't even matter if it is the debtor lying and saying it is a bad #. collectors are supposed to abide by whatever information is given to them, even if they have an 'inking' they are being lied to.

if an indiviual continues to get calls from an agency for someone else, there could be a valid reason for this. for example, the company i work for is a world-wide company which handles all kinds of financial matters for numerous creditors. let's say joe debtor has 3 different credit cards, a cell phone bill and a car payment that are all in collections. and let's say, by chance all of those collection accounts are with one company. it's likely each one will be handled by a different 'department' or even call center within that company. and let's even say each department was given the same wrong #. so now you have 3 different credit departments, the cell phone department and the car loan department all calling the same #!!! once you notify one department that they have the wrong #, it isn't always possible to update the other departments because they could be in a different building, state or even country! even if a particular company name and # keeps showing up on your caller id, that doesn't mean it's in regards to the same debt. it could be several departments within the same company trying to contact this one debtor.

now, to answer the question as to what to do...

if you know for a FACT it is the same company calling about the same debt and it's from the same call center; that agency is in complete violation of fdpca law and it should be reported to the ftc. i would log all call times/#s. and if you want to spend time on it, certainly pick up the phone and ask them questions.

collection agencies, in general, can only call from 8am to 9pm. the time zone is where YOU are, not from where they are calling from.

Your post clears a lot of confusions around. And most of us dealing with illegal collection practices will get better ways to handle it.

As I said in my previous post, you should join this board. You are losing all those debtcc points that can be later redeemed.

thanks ben. one thing that irks me more than a debtor who skips out, is a collector or agency who uses unfair collecting practices!! i sent an email to someone a few days ago asking how to join as a good samaritan. haven't heard back yet.

i think i did try to sign up but it said somebody would be calling me to discuss my debt? uh... i'm not in debt.

Fine. But when I told one of them that I am not the person he was looking for, why didn't he report it as a wrong #? Now don't tell me that there is no connection among different departments of one company in this silicon age!!!!

if i work for abc collection agency and i'm collecting for sprint on the 5th floor of the office building, and you tell me i have a wrong #, am i supposed to go down to the 3rd floor and tell cingular that the # i have is not for you? if i am collecting for sprint, i can only look up the sprint accounts that have been sent to my department. not only that, but collection companies have been known to use several different computer systems. for example, i use a certain dos based software and the department next to me uses a different windows based software. i can't look up their accounts and they can't look up mine. believe it... or not!

(and i don't work for sprint. just using that as an example).
