Can I deal with the original collector by law?

Hi all,
I have an older amer ex debt, that we would like to deal with. But I am not crazy about the debt collector who is trying to get it.
Is there anything I can do to work with the original company and not this one?


Not necessarily. Third party CA are usually hired under a contract which gives them authority for a certain period of time. Some contracts spell out that the OC will not negoitate or become involved in the collection activities unless their are documentable fdcpa violations. When a contract is in place, the OC must still pay the CA for payments sent directly in the to the OC.

If the OC won't work with you because it is contracted to a CA, try sending the CA a cease & desist letter..they will then immediately send it back to the OC, then you can talk to them. But be careful! This can ONLY work if the account is under contract, if it is sold, it very well may get you sued.
