I live in Louisiana and I have been owing back payday loans for about 4 months now. I was always getting calls from the Branch Manager at Advance America at least 2 times at work and 3 times on my cell. Well a few weeks ago, my fiance was home and she showed up knocking on the door for a few minutes and left a paper on the door with their phone number and a flier saying that they participate with the DA's office and how it's illegal and fraud and blah blah. Is she allowed to do that?? I am going to pay them back in full but I have not made payment arrangements and I have been ignoring the calls.

are they CFSA members.if so report them.also let them know you intend to pay.you just can't right now.to answer your question.they would have to go a long way to prove fraud.especially if you made even one payment.it sounds like a threat to get you to pay or at least talk to them.they more than likely can't have you arrested.debts are civil matters not criminal ones.i would talk to this person and just fill him in.ignoring this won't make it go away.especially a storefront.

How would I find out if they are CFSA members?? I've had loans with them since June 08 until the end of Oct. Around that time I had to get about 3 pdl's and I just couldn't pay them back. I changed my account number about 2 days before they were supposed to draft out of my account. I called the DA's office and a clerk told me that payday lenders do file cases with them but the worthless checks division was so backed up that they wouldn't get in court for at least 2 years

right worthless checks, not fraud like the manager was hinting at.to find out go to the branch.there should be a CFSA plaque or certificate.it should have contact info on it as well.i would also do as payday1111 advises at times and contact there corporate office.

According to the CFSA website, they list Advance America as a member. I would definitely file a complaint with them. CFSA was a big help in helping me to settle with one of my PDA's. Once I questioned the PDL about being a CFSA member, they finally offered a refund. Give CFSA a try, it can't hurt.

I agree with Shazzers.

I had a loan with Advance America store front and they lied to me and screwed up my checking account.

The "corp" pays for the membership to CFSA and the store fronts slap a sticker on the window but the store front managers do what ever they want. They do not follow the law or the CFSA rules.

Report them!

Report that manager to the Corp Office!!!! Call to explain and get an email from the person that you are speaking with to forward a scanned copy of the letter. If what you say is true, I would fire the manager immediately upon confirmation of the letter and bend over backwards to work with you on your account. That is me and my opinion is formed from years with one of the "big 3"!

Definately report them to their bosses! I have found that some managers will do whatever they want and count on customers not taking it to the next level.
With that being said, definately don't ignore them, as that's probably why you got the little housecall. Work out a payment plan and make sure it's affordable for you, then call them after that and spell it out for them.
