Criminal Action is prohibited in CA. If you are being taken to court it is most likely for a civil judgment.

Most states you can't be criminally prosecuted like California. There are a few states like Alabama, Alaska, Hawaii ,Colorado, and North Dakota and possibly a few more that allow prosecution if the check returned due to closed account.

In checking the California database, there are several companies with a DBA of this name and a business license, so the company could very poss be a storefront--but again, the worst that can happen per our state laws is going to Small Claims court and mediation. NO criminal prosecution. Could the collectors be coming out to play here?
