wage assignment,writ garnishment

A wage assignment is voluntary, normally in regards to a PDL. A writ of garnishment would be ordered by the court after a judgement has been awarded to a creditor. Depending on the state you live in, they may not be able to garnish your wages. If it is a student loan, then no judgement would be necessary. Can you provide more details?

Nascar Devil, its all about the credit card debt I just get nervous because even though I know the possibility of being sued is real, I just always assumed they have to properly serve you not just get a judgement behind your back. It seems some of the posts are saying their accounts got frozen and they wages garnished without them knowing it. I'm in California by the way.

CA does allow wage garnishment but only with a judgement. Here is some info for CA:(just select your state),

Nascar, thank you for the info i appreciate it, but how are some people having this done to them without a judgement? or is it because they have a judgement and did not know or answer it?

They either were improperly served and a default judgement was entered against them. Those could be vacated by the consumer. Then there are those who just don't respond to the summons and show up in court. They don't have any excuse so cannot generally get the judgement vacated.

last question I promise. Would it be a good idea to every now and them check with my local courts just to make sure. I have already made sure they have my proper address. I hate surprises especially when it comes to my paycheck. Thank you for being so helpful and kind.

If you are in a position where the possibility of suit is there, then yes. Depending on what county you're in, there will likely be online access to keep tabs on things.

The Sheriff's Department served a Wage Garnishment several weeks ago, but I have not received any notification. How will I know that the employer will be garnishing her wages and sent to me?
