being sued by Sessoms & Rogers too, they filed suit after ignoring my DV request, answered the court summons with a "can't confirm or deny"...i don't know what happens now? will i get a court date or something with questions on it from sessoms & rogers...do i have to file a motion for discovery now? or should i just wait? (never been sued, defending myself)

Now that you have answered your summons you pretty much wait. Soon you will get from the court a date for a case management conference or pre-trial conference. It will most likely be from 3 or more months from now.

What you will get from the attorney will be interrogatories, request for production of documents and request for admissions.

discovery is not a motion, it is the current phase that the case is in. During the discovery phase, the things I mentioned above and anything else needed to defend the case from either side are brought forward. The point of the pre-trial conference is to see the readiness of the case and make sure everyone has what they need.

I received a summons in March, and have a case management meeting in a month. I still have not received anything from plaintiff's attorney. Is that odd? I would like to send the plaintiff a request for discovery, etc. Should I do it now, or wait until after the case management meeting?
