We live in Oregon, and my Fiance received what we now think is a court summons for past due medical bills (over 6000) we weren’t sure what is was, but today we got notice in the mail that a collections agency is going to start garnishing his pay. Due to the current economy down fall he is laid off. We have 2 children and one on the way. If they garnish what little we have, that would be devastating. Can they garnish unemployment benefits? What are our options now that his account is in collections? And do they have to have a separate judgment in order to garnish from his bank account? And what if it is a joint account and we aren’t married yet?

You seemed a little suprised about this? i do not believe they can garnish unempployment benefits, are you sure that you recieved a court summons or is it just a letter threating a summons?
