I live in MI. I seriously need to get out of these loans. I want to pay them off as soon as I can, but at this point I can only pay on these once a month. I am ashamed, scared and embarrassed, I even got myself in this position in the first place. Payments are due on each of these loans Friday and I don't have the money. It's either pay them or dont' pay my rent, and risk getting evicted. I really appreciate the help.

Payday Max -Internet - $980 - $547 in fees - thus far
Check N Go - storefront - $600- 1st pymnt $225.00 due Friday.
Advance Amercia - storefront - $600 - 1st pymnt $225.00 due Friday.
AAA Payday Cash.com - internet - $300 - $225 in fees thus far.
First Bank of Delaware - internet -$1300.00 - 3 pymnts of 79.80 left.

Hi Kim, I understand how you feel, I have been there, just like many other people here, BUT, there is a way out of this! My first suggestion is to request the EPP (Extended payment plan) at the two store fronts, you must ask for this BEFORE your payment is due, this will allow you to pay these off in 4 separate payments on each payday, if these stores are members of the CFSA (And I think they are), they must offer you the EPP plan.
The guidelines for CFSA members are below regarding the EPP plan:

Quote:

Extended Payment Plan *. Each member will provide customers who are unable to repay a payday advance according to their original contract the option of repaying the advance over a longer period of time. Such an extended payment plan will be offered in compliance with any requirement in state law to provide an extended payment plan or, in the absence of such a requirement in state law, in compliance with the Best Practice ???Guidelines for Extended Payment Plans.??? A member will adequately disclose the availability of the Extended Payment Plan to its customers in compliance with any requirement in state law for such a disclosure or, in the absence of such a requirement in state law, in compliance with the Best Practice ???Guidelines for Extended Payment Plans.??? (Amended 7/21/08)

Payday max - Also known as Credit Protection Depot
Paydaymaxsupport (@) CreditProtectionDepot.com -Illegal

The First Bank Of Deleware is a legal loan and will need to be paid back, looks like you are almost done with them anyway?

I'm not sure about AAA Payday Cash but I am willing to bet they aren't legal, something tells me that may be a cover up name but I don't know for sure, perhaps someone else will know.

You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.
What should you do?
Close your account asap, if you are unable to close your account, go into your bank and ask to speak with the Branch Manager, tell him/her you need a hard debit block placed on your account immediately! Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. This is your privilege, do not accept no for an answer. The following link will provide you important information regarding closing accounts. CLICK HERE

What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)
RE: Hi Shazzers. Thank you so much for replying. I am on a payment plan with the storefronts. Problem is I cant make any payments until the 20th and the first payments are due Friday. I have taken out two previous loans with PaydayMax and have paid them both back. This is the first time, I have had trouble paying any of my loans back. AAA loans seems to be in UTAH and this is the first loan I have had with them. I hate I even took out the loans in the first place. If I get my bank account closed (I already opened a new one) how can I pay back the First Bank of Delaware? Should I get some prepaid debit cards? Also what will happen if i can't make my EPP pymnts of Friday? Should I call any of these companies and let them know. Sorry if I'm rambling, I'm really nervous and scared. Thnk you for your time and assistance.

I would call the store front companies and let them know you can't make the payments. They may wait for the first payment but they might not and then they will deposit the check you wrote them.

I had an EPP and made the first two payments but then could not make the third. I didn't call them and the PDL processed the check I wrote messing up my bank account.

I think with most of these companies (legal ones) communication is the key. If you go in person and talk to them, I am not saying they will be nice and they may talk to you like your a child, but your are showing good faith and assuming responsibility. You look more credible and they may hold off depositing your check. Talk to the store manager if you dont get anywhere call their Corporate Office.

Thank you everyone for your support and information. I have been a complete nervous wreck and have not slept in two days.
To update everyone. I have closed my bank account. The branch manager put a total hold on all funds/transactions on the account for a year. She opened me a new account yesterday. I also opened a new account last Friday at an entirely different bank, and switched my direct deposit to that bank. The first test to see it the account is really locked will be tomorrow. I will go to the two storefronts and advise them of the situation, and see if they can work with me. I know the mgrs at both stores, so we will see what happens. I want to pay Check N Go online/First Bank of Delaware the remaining pymnts in two weeks and pay both of the storefronts $300 in two weeks and the rest next month.

As for the two online ones, I have checkes the State of MI website to see if they are licensed http://www.dleg.state.mi.us/fis/ind_srch/ConsumerFinance/Search.asp , and it does not show either of them for the State of MI. So I will email, fax, send certified mail the letter Shazzers recommended to me. Hopefully this will resolve the issue and I can settle with them as soon as possible. If I have forgotten anything, please feel free to let me know. I will let everyone knows how it goes. Thank you all so much for your help.

Well so far, it appears the freeze on my old bank account has worked. I have checked it a few times today, and the balance is still 0.00 and nothing has posted. My direct deposit went to my new account with no issues. I contacted First Bank of Delaware and advised them, of the issue and when I would paying them the remaining three pymnts. The CRM advised that the pymnt had been rejected by my bank, and collections would contact me on Tuesday, to set up pymnt by prepaid debit card. I haven't heard anything from the two internet ones yet (they may not be open since they are on the West Coast). I faxed and emailed my very extensive letters, and will be mailing copies by certified mail after work. Once I go to the storefronts this evening, I will update. Thanks again for everyones help.

Latest Update:
I went to the two storefronts today. The Check N Go manager (Fatima) wasn't there today, she won't be in until Monday and the payment is not due till then anyway (I found out). The Advance America Manager (Carol) was really empathetic and helpful (which I expected she would be, but you never know) because I know her pretty well. She called her RDO to see if she could delay sending the check, (because I'm on a EPP). He said he would like to help, but MI law says they have to present it. They know it's going to come back rejected, but they will waive the $25 fee, and I will make a payment on my next payday. Both storefront managers are really great people so I don't anticipate having any issues with paying both loans off by the end of next month. I haven't heard a peep from the online loans. They haven't called, emailed, nothing. I don't know if that is good or bad. My email/fax/certified mail letters were a mix of templates Shazzers gave me, and ones I found on the site, so they were rather detailed and lengthy. I checked with my banks branch manager again to make sure the account was completely frozen and it is. I will keep everyone posted. Thanks again for all of your help.

Since my last post, thinks have worked out well with my two storefront loans and my First Bank of Delaware loan. I hadn't heard from the two internet loans until today. They called me @ work/home/cell. I faxed/emailed/sent certified mail to both last week. Has anyone had any success with settling with PayDayMax or AAA Pay Day Advance? I was just wondering, because I'm a little concerned about how they will escalate the issue. In my letters I stated how much I have paid in interest, and that I am only obligated to pay the principal, and I was willing to pay what was left in the principal amount. Should I just ignore their calls, or try and talk to them? Anyone have any advice/encouragement? :? Thanks.

Latest Update:

I have only received one call from the internet payday loans. I have faxed/emailed my letter several times. I sent the letters by certified mail Wednesday, but do not show they were delivered/accepted on the USPS website. Wednesday I received an email (below) from Credit Protection Depot. I notice the amount they want to place my account on "hold", is close to the amount I would have left to pay off the loan without interest.

The email states "I would highly suggest you call 1-866-645-1661 to resolve this matter immediately. This is the only way for you to resolve this very serious situation, which you have initiated. You need to go to Western Union and get the BLUE QUICK COLLECT FORM (or go to www.westernunion.com and choose the quick collection option). You can also use your debit card or various charge cards at www.westernunion.com.

One I think if they really wanted to resolve the issue and get their money, they should be willing to recieve payment by any means besides Western Union , second the "you can ONLY call business if fishy. I resolved my First Bank of Delware issue through email. They had no problem with making arrangements with me by email. I think the Western Union only speaks to them being outside of the US, and the call but we wont put anything in writing speaks to them being totally illegal. I could be wrong, but my legal payday loans have being very accomodating at resolving the issue.

I searched the forum and saw that other people have received the same if not similar email, but I don't see any posts that say that anyone has resolved their dispute with PayDay Max/Credit Protection Depot. If anyone has had any success with dealing with them, it would be good to know. Thanks again for everyones support.

It has been a while since I've updated my post. There hasn???t been any new developments other than the email I received today. My old bank account has not been reopened and my new ones have not been debited. I filed complaints with the MI AG and the FTC, and received a letter saying the AG was reviewing my complaint. I have paid off my First Bank of Delaware loan and things are going well with my storefront loans. I almost have both of them paid off. The store managers have been very helpful and understanding. As for the remaining two illegal internet loans: AAA Payday Cash called a few times but once they signed and received my Certified Letter I haven't heard from them. Credit Protection Depot calls once a day and never leaves a message. I have received two emails from them since the initial one, the last one yesterday. I have faxed my letter NUMEROUS times and they have yet to even acknowledge it. Speaking to them is useless because all they do is lie and threaten you, so I don???t bother answering them when they call. I just don???t get how they are so unwilling to at least settle for the principal amount on the loan. I am more than willing to pay them the $433 remaining on the loan, but these people won???t in anyway even attempt to work with you. If anyone has any thoughts, please feel free to reply.

Gotta love the effort in that copied and canned response. "ONE-TIME opportunity" OMG run??to the bank!
??
They are illegal and they know it.
??
Let it turn over to collections. The loan was illegal so the collections are illegal.
??
IF they report to any credit bureau then dispute it.
??
Teletrack is used by other PDLs and Rent-a-Centers. Don't even bother with that threat.

Thanks nohiogal . I figured it was some BS. The fact they call my cellphone almost everyday, (sometimes my line at work and at home) but has never left not one??message, pretty much sums it up for me. I don't like the fact that i still owe them money, but I don't see how I can pay them when they won't listen to reason. Do you think I should just WU them the remaining amount??and be done with it? Also, I have serched the forum and couldn't find one post that shows anyone getting anywhere with these people.
