taxes on Judgement

My friends at Citi Bank claimed I owed approximately 14,000.00. I had held the card for 15 years - no problems - then they upped the interest rate because of a late payment on another card. I claimed that they had no right to up my interest rate - long story short, I stopped paying them anything - that is when my bill went to 14,000.00. I believed I had a case - so when they sued my - I went to court. In a judgement - the court decided I owed Citibank $4,800.00. I paid the judgement - and then yesterday recieved a 1099 for almost 10K from citibank. In that it was determined that I owed $4,800.00 by the court - isn't the 1099 mistakely issued?


Credit card companies CAN increase your interest rate at any time. By stopping paying you defaulted even on the portion of your debt that would have been on the old rate.

You lost in court but the court decided your settled amount would be $4800, thus forcing citi to write of the balance.

What you are all missing is that Citibank did not forgive the debt. The Court ruled on what the correct amount of the debt was. The excess was not forgiven it was determined by the Court to be invalid.

I suspect the OP has a legal claim against Citibank for fraud based on the theory of law that once a Court fixes the correct amount of a debt by awarding a Judgment, the plaintiff in this case has no right to simply increase that amount under any circumstances.

Hi Mike,

I totally understand the angst as to the 1099. It sure doesn't seem fair, but the IRS will use every opportunity to bleed more taxes out of you. But that is one of the problems with debt: you pay the creditor usurious interest, or you pay the government. Or, best, get debt free and live without credit. It's a huge rip-off anyway you slice it. Makes me want to watch Fight Club again.....
