if your not working, and you have tried to make payment arrangements, they will not accept what you can pay, what can they do to you?


First of all, please list the following information so we can help you. I am moving this to the payday loan section so more people will see it.
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.
I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. the payday loan company is Cash Advance, in albuquerque Nm, the loan amount is $500, i made 3 payments then lost my job. I also have one at Cashco for $500, made 3 payments there as well. I told them i wasnt able to pay and asked to make payments, they both said i could make them, but it would not stop the phone calls or the fees from piling up. It has now gone to a collection agency that tells me they are going to have their lawyers contact me and start wage garnishments. I have a part time job, had to move with my mom so i can't pay. i cannot afford for them to garnish. don't know what to do...

Since they are storefronts, they can easily take you to small claims court. I would write them a hardship letter (as opposed to just asking) detailing your situation. You could take that as proof with you to the court that you tried to work with them, and since you acted responsibly, the court will likely side with you.

As far as garnishment, 1) it would be voluntary on the employers part (and they will likely deny the request) 2) they would need to file for a judgment. Since you are only working part-time, the court will likely side with you.
