just wanna give lil heads up. cause it happened to a friend here in las vegas. he's got so many bills that went to collection. and never paid'em ever. the creditor reported him to the irs and now he's gettin NOTHING from his income tax. so if you guys gots lotsa pdls/collections etc try to work with them even if just partial payments. which i start doing today. because i want to keep my income tax money. these creditors/pdls are being smart these days they will do everything they can in their power to get their money back. hopefully this year i get all my pdl fully paid and done. jst wanna share that with you guys

A PDL or collection agency can not just seize your refund.

Here is an article about who can take your refund.

From WikiAnswers..."With a judgment lien can a tax refund and bank accounts be garnished?"

"If the judgment is for state or federal taxes then any refund is subject to seizure by the agency holding the judgment.

If it is a creditor judgment, a tax refund would only be subject to attachment if it were placed in a bank account that was being levied by the judgment creditor."

The IRS would have told the creditor or PDLs to pound salt and to take him to civil court.

It does raise the issue of direct deposit of your refund. If you do the electronic filing and have it deposited to your normal bank account then it is subject to the PDLs getting it if you have not secured your account.

Some may want to elect to get a paper check or open a new account and have it deposited there instead.

By law they have to send something to your bank, AND all they have to do is look through check systems or something to that nature to search your bank account, they can place a judgement on your checking and you not be served. I got served AFTER they put a freeze on my account, as long as the bank gets their notice, it doesnt matter if you do or not. I never paid that bill with a check from my account or had anything debited as well, its easy to search for your bank info...just like they can look up your work info. Its the program that costs a whooping $19.95 a month unlimited and you can trace where anyone is as long as you have the social security number of the person your looking for. Also known as "skip trace". Some people are smart, they know its tax time and serve your bank with papers around the time they know your gonna file...happens to the best of us.
