I was paying on my credit card faithfully until about Aug 2008 and due to financial issues, have not paid anything since. I think I received a letter of judgment because there is no court date on it. It just says that I need to file something in writing with the court. The lawyer/CA are stating that my current balance due is $2064.07(my original credit limit was $1500.00). They are also stating that they are entited to an additional interest rate of 6% per annum on the unpaid balance from November 13, 2008.
Another question that I have is about a payoff amount. How much should I offer on this balance?

i would first check with your court clerk for clarification.make sure there is a judgement or court date.if not send DV and C&D letters.send them certified mail return receipt.if so there should have been a list of questions to answer.if this is a judgement look into having it vacated for improper service,but check with your court clerk first.

At the top of the "judgement" or whatever it is, it says complaint(in all caps) then it has 7 statements which it seems to me like they are "stating their case". For example it states that I opened the credit acct and made use of it and the balance is listed here. It also states that I am in default by failing to make the monthly payments when due, etc.

It is noterized and has a cover letter on it from my county court office stating to call the court administrator if i could not afford an lawyer,etc so it does "seem" legal.
