I was wondering how some of you would interpret the response I received from Impact Cash. I have included the emailed conversations between the two of us and wonder if this can be taken as a PIF for my account with them. It is probably easier to start reading at the bottoom of the post and work your way up.

Nicole,

Payment arrangements were made after I had received an excessive number of phone calls and emails from multiple representatives of Impact Cash. On average I received two calls and two emails daily. After the continued harrassment at the workplace, I took the initiative to learn what rights I have as a consumer.

The state of Illinois does have laws and regulations regarding payday loans. This information can be found in the Illinois State Constitution. Article 2, sec.2-5 of the Payday Loan Reform Act states "No lender may charge more than $15.50 per $100 loaned on any payday loan over the term of the loan."

The Illinois' Attorney General's Office and FTC also support this information regarding payday loans and collection practices.

Again, I am requesting that my account be settled with the ammount that has been paid thus far as it is beyond the amount that is actually legally owed.

Hi Nicole,

I am hoping you can assist with getting some matters settled with Impact Cash.

I have been receiving 4-5 calls a week for months now at my place of employment. Sometimes the caller ask for me and other times they ask for a gentlemen name Jose. I've asked on each call that my number be removed but yet the calls continue. These calls have now put my job in jeopordy and must stop.

Also, it is my understanding that I have paid $457.50 on a $350 loan yet still have an outstanding balance. Under state law, pay day loans are subject to a maximum of $15.50 in interest/fees per $100. With my calculations, the maximum amount due for a $350 loan should be $404.25.

Will you please advise as to the remaining principal balance Impact Cash claims is due. After my research, it seems as though my account should be paid in full and all communications between the company and myself should cease.

Thanks, I emailed and her response is below. I have entered into an EPP, but the dollar amount is almost twice the amount of the loan.

No problem, once your last payment goes through on 3/9/09 then your account will be totally cleared.
