I have been up for countless nights researching some answers and came across this website and it appears to be very helpful to everyone else so here I am. looking for some direction. A drunk driver totalled my car while is was parked. The insurance company paid off my car (minus $700) I was left to go out and start from scratch trying to get a car with no money. This is where my borrowing began, initially to cover a rental car to go back and forth to work and get my son to all of his games etc. As many of you I started with one then two then another to cover the fee's they took out that made my paycheck short on another bill then the next check another to cover the fee's on the previous 3 loans and still pay the rent and new car payment and it continued from there. Christmas came and went at my house. my son was quite sad but had to understand the roof over our heads and food on the table was more important. now we are at the point of not having a roof. I have not seen 1 cent of any paycheck since 2009 started. no car payment has been made (jan or Feb) no rent has been paid (jan or Feb) I can't continue like this but something has got to give here. I dont want to end up with any more negative items on my credit report (as I have been working towards cleaning that up for the last 2 years to be in a position to purchase a house for my son :)) I have been doing some reading and I don't know whether to put my bank account on For Deposit Only status or close it out completely. the bank has already informed me that I will have to bring my account current (out of the negative) in order to close it. I have 2 other accounts already open at that same bank that I have rarely used, if I should decide to close the one the payday lenders are effecting. I also have one more open at another bank all together. So I am not concerned about not being able to get another account. What should I do to begin this process?

I have the following loans currently:
7/10/09 500fastcash borrowed $300 paid back $975 (in full)
10/10/08 Centurion/loanpoint USA (I think) borrowed $500 thus far have paid back $1200 (and they continue to debit $150 each paycheck)
10/17/08 CityviewCash borrowed $300 thus far have paid back $635
10/30/08 Webpayday borrowed $500 thus far paid back $1080
11/3 CMG borrowed $300 thus far have paid back $660
11/5/08 PaydayLoanYes borrowed $350, on 11/21 payday they debited $175, $175, and $30 total $380 (have no clue what that was about but was quite hostile when I called and of course there is nothing they can do)
11/25/08 First West coast/Atlas money online (I think) borrowed $350 thus far have paid back $420
11/25/08 MTE Financial borrowed $300 thus far paid back $450
11/26/08 Ameriloan borrowed $300 thus far have paid back $390
12/3/08 Avantis Financial borrowed $300 thus far have paid back $442.80 (the way they figure out the finance charge is quite odd and come out with change ?!?)
12/13/08 Sagemore borrowed $300 thus far have paid back $300 and counting(what do ya know!)
12/15/08 500Fastcash (yes another one. the first one was overly paid in full) borrowed $350 thus far have paid back $315

That is where I stand at this very moment. between all these fee and the back NSF fees for my auto debit bills that continue to bounce I have not seen one nickel in 2009. I am thankful for friends who will give gas money. I stopped my direct deposit for next week so some how some way I will have some money to start paying what I owe because now the light company could care less what my issues are and have threatened to cut me off (I dont qualify for any assistance they say!!) My rent is past due I am on my second past due on my car, don't want my insurance to cancel and my phone has already been shut off. I am so frustrated but trying to hold on and keep the faith that there is a light at the end of this dark road. This was a very expensive lesson to learn. I will say say that payday loans can work when you are in a pinch and you have one or two, but beyond that you run into the cycle of having to get more and more to cover the fee's and still maintain your bills and more. then it gets really ugly when you have to explain to your child why there is no more cereal or milk and "No we cant go to mcdonalds, we need this money to put gas in the car". I just feel so overwhelmed at this point. I pray someone out there has some news that will put a smile on my face and help me sleep at night again.....Anyone? lol

You have more than paid your loans off. You owe nothing more at all. As far as your bank account goes, you really nned to get that in a positive balance. even though you have other accounts if that one remains in the negative when the banks do their sweeps ( which they do every 3 to 6 months) your other accounts wil likely be closed. All banks see the telecheck reports so it does not matter where your accounts are. They will probably be closed (with cause). Please bring that balance positive

Hello everyone. I'm here to give an update. On 2/13 I went to the bank and because my account is negative could not close it. They did however place it on For Deposit Only Status for now. On 2/24 I e-mailed out the letter with the ACH revocation, C & D letter, and wage garnishment revocation and refund request letters. today I received one PIF already!!!!! yes and the phone is still ringing but is sooooo much more quiet than it been for the last month. OMG!! It is really working. I am so greatful for this site. I don't know what I would've done. It seemed like it would never end. :-D I still have been receiving phone calls from this nasty woman at 500 fast cash, and Atlas money keeps sending me back the same standard e-mail they always send saying thank you for your e-mail however you still need to contact our collections department by calling 1-800.. I replied to them stating if they read my e-mail they will see where I have clearly stated I WILL NOT BE CALLING ANYONE. I need ALL correspondance in writting and am looking forward to them getting back to ME!! so we will see what happens from here. :-) either way I am so happy things are looking so much brighter. one down eight more to go. One day at a time! So now my next steps will be to send the copies of the letters to BBB, FTC, AG, my HR dept, and my bank, right? I look forward to your response :-D thank you again everyone.

mzbeonita1, when the collection agency calls (if they do) request, remind them that all Payday loans are illegal in CT, period, and you will not be making any payments to them or the Payday loan. By law they have 5 days to send a dunning letter (which I doubt they will) I would then ask for their fax number and fax a C&D letter along with a DV letter. I would also try and get a mailing address for them, though doubt they will give you a valid one. They will try and tell you you will be going to jail for internet fraud etc etc, and try and force you to make a payment. (If you happen to answer the phone). If they call after you send them a C&D report them to your States Ag, States DFI, FTC etc.

ok well 500fastcash and webpayday are still calling me at work, Atlas money has sent me an e-mail saying payment was returned for non sufficient funds and to contact their recovery dept. The kicker was today i received the following e-mail from some company called NRS (anyone familiar with them?)

This communication is from a debt collector trying to collect a debt. All information obtained will be used for that purpose.

Then about an hour later I received another e-mail from the same company with a different account number saying the client is CMG Group LLC. The body of the letter was EXACTLY the same as the first one (INCLUDING the dollar amount they claim I owe) I think someone made a boo boo and forgot to change the amount. lol I paid Sagamore the principal amount plus and CMG I paid them back double what I borrowed and sent a letter requesting a refund and to mark my account paid in full with no response as of yet. Maybe tomorrow I will take a trip to the post office and mail them certified and see if I get any better responses.
As far as this NRS any advice on what to do with them?

MTE just sent me this response:
We received your initial complaint on 2/26/09. Our response was sent via email to you on 2/26/09. In the response, we offered to waive your $90.00 finance fee and settle for your $300.00 principal balance as resolution to your complaint. We also stated that your response needed to be received within seven (7) days of the date of our offer. To date, we have not received a response from you.

Due to the fact that we did not receive a response from you, the offer is now null and void and collection efforts will resume. Your account will be turned over to an outside collection agency for collection of the full amount due, including the principal balance and finance fee, as well as any collection fees due. Once the account has left our office, we will no longer be at liberty to make any offers to you to settle the debt.

We feel that we have made every effort to resolve your complaint amicably and find it very unfortunate that we were unable to do so without the involvement of an outside collection agency.

Thank you for your time and consideration in this matter.

Respectfully,

Compliance Department

So now what do I need to do?

This is the e-mail I received yesterday:
[size=2][size=7]Thank you for your attention to this matter. This is your reminder of your promise to pay arrangement for your CMG Group LLC account that you asked until the 3/13/2009 to pay the in the amount of $ 528. This is to confirm that you will make the necessary arrangements to pay the promised amount of $ 528. Please respond to this email with your acknowledgement that your promise will be kept. You agreed verbally that you understood the situation and that the funds must be available on 3/13/2009. If these funds are not received for any reason your account is subject to a broken promise subject to an OFFICIAL REFUSAL STATUS with our company. If this promise is not kept your arrangement is null and void and further collection activity will resume. Once your final payment clears your account will be updated immediately upon receipt.

Once again we appreciate your attention to this matter and happy to help resolve the situation.

Thank you,

NRS, LLC

Payday loans are prohibited in CT making the loan and the collection of the loan illegal. Also, have you checked to see if the Collection Agencies you are dealing with are licensed to collect in your state? Personally I believe you should continue to stand your ground with them, if you have paid back the principal you are done, if not do not pay one penny over the amount you originally borrowed. Continue to pound home the fact that payday loans in the state of CT are prohibited.
