Pro Collect SOL Expired

My husband received a letter from Pro Collect Incorporated about a debt from a dentist. I sent them a validation letter in which they sent me a copy of the account history. The last payment made by my husband was 11/20/2000. The history shows that letters were sent to him in October 2002 and then it says it was uncollectable on 1/24/2006. I know that the SOL is 4 years in Texas but before I send them a letter telling them that I want to make sure. Does anyone have a good letter to use for the SOL that has expired?


You could use something like this one,It's up to you but this is how I would do it. Yes the SOL in Texas is 4 years so a complete cease and desist is in order to shut them up. as long as you have proof then do nothing but send them this letter. If they ever sue you, you have them over a barrel and are looking to score some buck from them.....You should also check your credit reports to be sure they haven't been poisioned by these companies.

This will serve as your legal notice under provisions of federal law, the Fair Debt Collection Practices Act (FDCPA), to cease all communication with me in regard to the debt referenced above. If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission who is responsible for enforcement, the States Attorney General office and/or the American Collectors Association or local State Bar Association.

I/We have decided that we do not desire to work with a collection agency under any circumstances. Do not contact me any further by any means. All collection efforts are to stop upon receiving this letter. The alleged debt is time barred.
