I called their office in reference to a summons I received from them and they wanted me to give them my social security # and when I started asking could we look it up by account number they hung up. Is it standard for them to need your ssn?


DO NOT give it to them. If they have it there is no need for them to ask you for it. My guess is they don't have it of only have the last 4 digits.

You said you got a summons, when did you get it, have you made sure it was real and if so, have you filed an answer yet?

What state do you live in?

What are they suing you for?

When was the last time you made a payment?

Anything else you can provide will help too to see what your options are.

Its a real summons. Court served and everything. I have my answers ready to file and I have to have it done by friday. I live in GA. I called just to see what I might could get for a settlement since I received a letter from them over the weekend wanting to resolve it without further legal procedures and that they and their client would like to reach an amicable resolution. Figured I might get a cheap settlement just to be done with them. They suing over a Goodys card that defaulted in 2007. says 1491.58 plus interest 125.04 plus court cost 106.00 for a total of 1722.62. The card that I had back them didnt have but a little over a 1000.00 credit limit.

and I also offered to verify the last 4. told him I'm sure they had that. politely told me if I didnt give him my ssn he would have to hang up and when I didnt he did.

(1) Defendant affirms the statements made by Plaintiff in paragraph 1.

(2)
The Defendant is indebted to Plaintiff in the amount of $1,491.58 as principal and $125.04 as interest.

(2)Objection, Defendant never engaged in any business with Asset Acceptance LLC and requests proof of
the amount owed, showing what agreements were made for the claimed amount. Defendant has not been provided any information to show that Plaintiff has legal assignment over any debt owed by Defendant to any creditor.

The principal and interest are past due and Defendant refuses to pay.

(3) Objection, Defendant has never entered into any agreement with Plaintiff, and therefore has no obligation to pay Plaintiff anything.

WHEREFORE, Defendant demands that judgment not be granted to the Plaintiff as they have not proven that they are legally able to collect on this alleged debt and have not proven that the alleged debt is even the Defendants.

That looks pretty good to me. That's all they put on the complaint? They really suck, must be the toxic mold in his office getting to him.

It is really up to you if you want to settle, but before you do, read this. It will change your mind very fast.

Isnt it interesting when you call looking for dennis henry he isnt ever there? And the only henry listing on their automated speech is for an alice henry which when you try to go to her extension it always rings back to the receptionist.

Sounds like they just filed the lawsuit hoping you would not show up and they would win by default.
If they call again, let them know right away that you are recording the call and it may be used in court.
More bottom feeders who have nothing better to do other then stress out people who are already stressed out with everything going on.
Hang in there, show up to court and when they DON'T show.....you can get a judgement. If you have letters showing you tried to contact them for proof of the debt, etc, take anything and everything with you to court just in case.
If they don't even have you SSN and they give you a bogus name, they are up a tree.

this co. filed suit against me,a 65 yr old senior citizen, on disability and only income is ssi and social security. I got advice from ga. elderly legal assoc. plus help from OUR HERO Mr. Bud Hibbs. I followed it and did show up in court,and sure enough, this Mr Henry guy did not show up. .good luck and lets fight back against these bottum feeders. I understand they are under investigation by not goca but the ftc. AGAIN'''

pretty interesting,when this co's name is brought up in court,the judge just hangs his head. I am sure these judges are sick and tired of these bogus lawsuits,especially when this outfit doesn't even have any proof for their claim. as tax paying citizens,we really can stop this horrible co. from harming any more unwary citizens.

actually,I was hoping to see the face of supposed lawyer,that would first of all file a ficticious amount of money they were asking for,then when they were notified by certified letter that the only income for me was ssi and social security,and I live well below the poverty level,I guess I didn"t realize that this type of character really existed. but you know,what goes around ,comes around. huh?
