Today I talked to Tony from PN financial after playing phone tag for weeks. I am not quite sure what to do. I left one msg a week ago for him bc they sent me a letter for a HSBC orchard bank account and I have never had one of these and let him know that in the msg. Well today I talked to him and he said it could possibly be an orchard bank, boa, or citigroup mastercard. I told him again I have never had any of these and he said he would go talk to the attorney, he came back and just kept saying the same thing that it had to be one of those accounts. I told him all I have had was a visa then he said he was looking up my info, then commented on my credit report and how I needed to clean it up and said it was probably the providian one. That they can't keep track bc of them getting bought by different credit collection companies and the banks getting bought out. He started asking me my info and said oh yeah I talked to your stepfather, I thought that kinda strange. I keep questioning the account and telling him I was confused on what it was. I told him I needed more info and that I wanted to look through my papers and talk to my husband and then he went on if I didn't have them paid by noon today they would start the process to sue me and get a judgement. He just kept going on and on and I ended up hanging up the phone. I pulled up my credit report today and if it is the visa they have it listed on there twice, it is past seven yrs and per transunion is scheduled to fall off in may of 2009. Of course the amount he told me was higher than my credit report but he was willing to settle. I really don't know what to do and it makes me skeptical if he couldn't give me the info I asked for. Sorry this was so long, but any info or advice would be greatly appreciated. Thanks.


He couldn't give you anything because he doesn't have anything. Don't provide them with nothing and if they call again tell them per the FDCPA they are supposed to contact you by mail within 5 days of the initial phone call and give you 30 days to dispute the debt, listen to what he says say nothing and hang up. He is a debt collector so he already violated the FDCPA by telling you to pay or they will sue you and get a judgment. He has no authority to say that.

What state do you live in? You said the last time you paid was 7 years ago? If the Statute of Limitations has passed then they cannot sue you legally, if they do you can get it dismissed for the SOL and counter-sue them for FDCPA violations.

the OP said it was going to be past in may.i still wouldn't give him a dime.i would send him a DV and C&D letters so fast he wouldn't know what hit him.send the letters certified return receipt.

Thanks guys. I live in WV, it looks like the sol is five years here. They also sent me a letter dated jan 13 telling me I had until jan 22 to pay or they were turning it over to their attorneys to commence suit, but however I still had time to pay. This came as a final warning but I have never received anything from this company, and the fact the guy couldn't tell me who the original creditor is. I didn't say anything on the phone except that I have never had an orchard bank account and that I wanted to know what account this is.

you can send the letters to a P.O. box. alot of members here have.just make sure you make it certified mail return receipt.still i'll try to ge a real address.

On 2-23-09 I talked to and agent name Mr. Roth and he sat up a payment plan for. He also made it where I could afford it since I am disable. So from I say thank Mr Roth and PN.

Ever since last week I have been getting calls from John Sullivan home based business, stating that I had an court case on his desk that I had to take care of before it would go to court. Well I finally got to call back today, this morning when I called they had me on hold for 20 min. I decided to hang up and call back later. I called back this afternoon and first time when I called the gentlemen that answered said legal then he puts me on hold then a another gentlemen answers PN Financial his name was Tony Rich then I gave him the case number 73997. He said oh hello, I said to him that I was calling trying to see what this was about he said it was about a cash advance loan that I took out with a company and stated that I had to pay back 100% of the debt today. I was trying to talk after listening to him then he said you sound like a nice young lady that is trying to take care of this I am willing to help you hold on. The same person that said his name is Ron comes back to the phone after being on hold for 2 minutes and says I taked to the company and they are willing to let you pay less than 50%. He then goes on and says you will need to take care of this matter, I was trying to talk to him nut he began to get nasty and rude, he said young lady you need to listen to me I am talking and there can't be two people talking and if you want me to help you to stay out of court you need to stop talking and listen to me. Then he calmed down and said do you understand what I am saying as if I am a child, I said hmmm. So he goes on and says you need to give me your checking account number and I said, I don't have one he said ok a credit card will do. I said I don't have one of those either he said you don't bank with __________ anymore I said no. Then I asked him could he mail me this documentation so I could look it over and mail in a payment, he said no I can fax it to you or email it to you. I stated to him if it is a legal document you will need my signature, he said no you do not and repeated I can email it or fax it to you. Then he goes on and said trying to get your mother, father, sister, cousin or friends credit card information to see if they can help you out. I said I could not do that, then he says ok this is what I am going to do I am going to keep you file on my desk for 24hrs you have until then to get back with me and let me know what you are going to do. Before getting off the phone I said can I have your name please he said hesitately my name is John Sullivan I am the Attorney, now this is the same person that told me his name was Tony Rich.

Email me at personal info removed - Jason and I can tell you how to beat these guys. Trust me, they are not as scary as they make themselves out to be. All you need to know are the laws and what keeps them up at night. If you follow what I say, they will send you a letter saying you are paid in full and you wont pay them a dime.

The owner's name is Nelson Macwan and he is so low-down that he even screws over other collection agencies.

1. Most of their debt is out of stat meaning they really can't legally collect it from you.
2. Ask for a copy of the original loan/credit application you signed.
3. Tell them to call back and when they call back, record their conversation.
4. Threaten to sue them for violating the FDCPA unless they send you a paid in full letter immediately.
5. Get a lawyer with your recording in hand and then make some money by suing them.
6. Ask for a copy of their collections license in your state (many states need them) and they only have it in IL.
7. They all use Aliases.
8. There is no "legal division" and they don't have any lawyers on staff. If they represent themselves as lawyers then I believe this is a big law violation (check with your lawyer).

I received one of these letters too. I know for a fact it was an old cc account that I settled on back in 2005 so its a dead debt. Per this site I faxed a letter to the number on the letter stating I had a right to look at the actual documentation from the alleged creditor. This was done on 7/23. As of today nothing has arrived so they fell into the trap. If they are a legit agency it should not take this long to get documentation. They are BOGUS and I brought up their less than favorable rating with the BBB on the fax.

They took care of me by allowing me to make small payments of $25.00 dollars a month because I am on social security and live on a fixed income, so they treated me with great respect. Sorry you did not get the right rep as I did to help you.........maybe try to be open and honest as to your financial situations.. that may help......

People....seriously...this is a scam. Do not pay a penny to PN Financial. Do not worry about being sued. They can not sue you or make you pay them a dime. Do not lose sleep over these assholes. Keep the letters and report them to Attorney Generals office. Hopefully one day they will go to jail.
