I respect a consumer who researches the services to which he/she uses. With that being said when you applied for and agreed to the terms of the loan it would have behooved you to read the complete contract you were agreeing to. You are a citizen of the state of Texas, however the contract was not made in the state of Texas. The contract was completed via the world wide web, the governing law (clearly outlined in your contract) which you agreed to by your legal e-signature is based in the isle and providence of Delaware. When you spoke with Alison on 11/29/2008 at 2:28pm CST, she clearly outlined how the loan works and what the finance charges were, yet you still accepted the loan. With all the information at hand I am still willing to work out arrangements for the principal that is still owed on your account. We will cease debiting the finance charges of $90, however the account will not be marked “Paid In Full†until the principal amount of $300.00 has been satisfied. How exactly should I go about replying to her.. I know I'm going to tell her that I refuse to call the number and as previously stated I will make contact by email only.. and I want to point out again that all charges that they've already taken from me will be applied to the principal.

I thought that was strange too.. the Isle of Delaware? Their physical address listed on the website is KS. Well I found an email that someone had sent to a different PDL company on here and I tweaked it to fit my situation.. Here is how I replied to them.
Dear Kerri,
As previously stated in a letter to your company dated Feb 4, 2009.. I will only
correspond with your company via email or regular mail. All communication must
be in writing so that I may keep accurate records as I've been instructed. I
will not be calling the telephone number to set up payment arrangements. Instead
I will set up arrangements by email.
As stated in the aforementioned letter, I will sending payments to a physical
address in the form of a money order, as you are no longer authorized to debit
my bank account. You verify that the address on your website is the correct
address to mail payments or you must provide me with a physical address to mail
my payments. I will not Money Gram or Western Union any payment. If no physical
address is provided for me to mail payment to, no payment will be made.
Secondly, the fact that this is an internet loan does not make it legal. Your
company is not licensed to do business in the state of Texas, and regardless of
whatever state the company is located in, you must follow the law of the state
in which the consumer resides.
I have never at any time during any communication with your company, said I
would not pay back what I borrowed. I have, however, done research on internet
payday loans since my dealings with your company and am now fully aware of my
rights as a consumer. I have every intention of paying back what I borrowed, but
I will only pay $300.00 minus the $270.00 in fees that I have already paid. Therefore I only owe your company $30.00.
I am proposing to send your payment on March 15th, 2009. I
will not pay a penny more than the principal borrowed. Upon the receipt of my final payment , I demand that my account be marked Paid in Full and this be
sent to me in writing. I will not agree to this payment arrangement until you
have accepted the terms in writing as I need copies for my records.

Honestly if you just read their email you do not have to be a rocket scientist to figure out they are not in this country!!! Who writes and speaks like that? Send them a copy of the Consumer Protection Laws outlining internet payday loan lending and who has jurisdiction.
