summons on debt we do not know where originated

My handicapped brother received a summons on a debt from North Star Acquisitions which we do not know where it originated. We have received no correspondence from them and the debt is several years old. I contacted the law firm asking for origination on this and do not know where to go from there. He does not remember having this debt and I have been taking care of his personal business for the last ten years and do not remember it either. I do not know if this was a debt incurrured under his name by another person. I need hlep in finding this out.


What state do you live in? Have you called the court to verify the summons is real?

If the summons is real you will have to answer it within a certain time limit, if not a default judgment can be entered.

When you say he is handicapped, Do you mean he is on disability? Is he an incompetent person? If he is on disability and has no assets he is judgment proof, A judgment can be entered but they cannot enforce it. They will try to talk people on disability into paying but all you do is tell them NO. Also tell them all money in your bank accounts is from exempt income and cannot be touched.

Lets see,,,,,,,,,,,Oh If he is incompetent, meaning he can't think for himself then you need to notify the court of that too.

Is there a complaint for the summons? It should state what he owes and who the original creditor was. Also who is the attorney for the plaintiff?
