I owe Amex $30,000.00, Discover $15,000.00, Cap One $2,000.00. I have sent an unsolicited letter asking for a settlement of 25%. I followed the mailing guide lines from this site, and it has been about 2 weeks since I mailed the letters. I received 2 letters today one from Discover in response to my settlement letter, and one from GC services asking about my tax refund. One more note I am answering absolutely no phone calls from the credit card companies. At first I answered some of the calls but they were very rude and it made me very nervous and I just can’t deal with it.

Amex- About 2 weeks before I mailed the letters I received a letter from GC Services wanting payment in full. Then I received my Statement from amex as well as other letters wanting me to work out a plan dated after the letter from GC services. I sent my settlement letter directly to Amex. My thinking is that if Amex is still charging me late fees and interest rate and still pursuing a payment then I should be able to deal directly with them.

My Amex Questions- Is there a letter to send to Amex requesting that I want to deal directly with them? Or Which would be better, dealing with GC Services or with Amex?

Discover- I received a letter in response to my settlement letter today, Discover says that my account does not fall within their guidelines for negotiation, and that they do not negotiate through the mail. They go on to say that they have payment options as well as reduced interest rate plans and want me to call.

Cap One- I have heard nothing from them.

Summary of questions- When should I send another letter? Do I need to wait for Discover to send me to collections? “I read in another post that they had to wait until the discover account was sent to One Corp?"

The phone calls have dropped off quite a bit, I will copy and paste the letter I sent below. I sent the same letter, I just changed the accounts. I would appreciate any help, comments or advice I can get. I really want to know if I am on track, or way off track. Thank you all for any help, Sincerely, Ola, H.


Dear Sir/Madam,

I am writing this letter to inform you of my present financial difficulty and to bring to your kind notice that I sincerely wanted to settle this debt issue for sometime now. But due to poor financial condition it was not possible. I am currently being treated for severe depression at a Psychiatric Hospital and am going threw marital difficulties. I would like to take care of the debt for the account number mentioned above. My earnest gratitude for your efforts in advance and I would like to take this opportunity to sincerely thank your company to help us resolve this issue and save us from debt burdened conditions.

The amount I suggest to settle this debt in full is $7,509.04. However, any references to late payment or charge offs on this account should be deleted from my credit file within 30 days of receiving the above funds.

At this time, I am making similar arrangements and negotiations with other companies in order to avoid filing for personal bankruptcy. I have limited funds at my disposal and will be able to pay only those companies who are willing to meet my terms. I doubt if I would have enough funds to pay all at the end of this month.

I hope that the above terms and conditions are acceptable to your company. On accepting my proposals please sign the attached letter to confirm our agreement and forward me a copy of the same. On receipt of your signed approval letter I will send you a money order with valuation of the amount stated above.

Hi jwhellinger,

Excellent letter. It's nice to see that despite depression, you are taking your destiny into your own hands. And that is something to develop a stronger self esteem over.

GC Services is apparently horrible, so I hope you get to work directly with Amex on that. After you settle with Amex, GC Services may still try to collect (they are notorious for that). Although that sounds stressful, forewarned is forearmed. So if you can settle with Amex, then you will might need to prove that settlement with Amex to GC Services, along with filing a complaint with the FTC and your State Attorney General's Office, if they continue to try and collect. But, I'm getting ahead of myself here.

I'd say reply to the Amex letter as if you were dealing with them only and have no knowledge of GC Services. Reference their letter on your letter, and include a copy of it with your response.

As far as waiting for responses to the letters, I'd say to give it at least a month. I do hope you mailed these letters out by Certified Mail, Return Receipt Requested. If not, it's probably best to send them again.

I like calling them. I would call Amex and try to settle directly with them. With Amex shoot for about 30% doubt you will get less as they would rather sell it at that point to a collection agency. Ask GC who owns the debt if you have to deal with them. If Amex still owns it and they have to get approval from Amex then the 30% still should be a good number to shoot for. With Capital one I would call them as well and you will probably get 40-50%. With Discover you are probably looking at 40-50% settlement as well. To get the best offers you need to aim for a couple weeks before the 180 mark which is typically the time they sell the debt and which is the time they are most willing to negotiate. Each company handles things differently.
