Is there a way to file a claim against New beginnings?

New Beginnings took $3000 of my money as Fees. I am really pissed since they did not settle with the creditor that eventually filed a civil lawsuit against me.
I would need help. Can I file a claim against New Beginnings in a small court? Since they did not settle my debt, why would they charge me so much in fees? I felt I pissed all of my hard earned money away to these rotten scoundrels!!! And I am in even deeper debt than before! No wonder this country is going to dogs!!!!

Unfortunately, that seems to be par for the course in the debt settlement business. File a complaint with the FTC, the more the merrier. They are in the process of investigating the business and perhaps introducing new regulations. They are sorely needed. Also file a complaint with the BBB and your state Attorney General's Office.

There is an attempt to regulate the industry - called The Uniform Debt Management Services Act. According to Section 26(a)(2), the firm must refund 65% of whatever set-up fees they have collected, plus the balance in your trust account, upon termination of your Agreement. It has not passed yet at the Federal level, but Colorado, Delaware, Rhode Island, and Utah have already enacted it on the state level. The main difference in Colorado's legislation is that they have added a requirement for all personnel to be Certified Debt Special-ists* by the Center for Financial Certifications, the International Association of Professional Debt Arbitrators (IAPDA), or the National Association of Certified Credit Counselors (NACCC).

I would bet there is more to this story that it appears. We don't know how long Roger_Dodger stayed in the program, how delinquent the account was before her enrolled in a settlement program , if he made all of his payments on time each month or deferred them.I know for a fact that New Beginnings have a 55% settlement guarantee so if you ended up getting sued they will refund you the fee they would have charged to settle your debt. There is still options even if your are sued like a payment arrangement if necessary so they can still handle the rest of the debt you have. I also know for a fact that after you sign a contract with NB they have a compliance officer go over the contract with you again to make sure you understand all of the pros and cons of the debt settlement process. No settlement company in the entire United States can promise you that won't be sued , PERIOD. Its not their fault you got sued. Debt Settlement is for people who are in a hardship and are overextended. They didn't cause you to have what ever hardship that happened to cause you to not be able to pay your bills and thus need the services of a debt settlement company. I am truly sorry that you got sued but that risk was clearly mentioned to you and I know this for a fact. OH, I am most certain that there is more to this story than it appears. It's why I said that his complaint was par for the course. Complaints lodged with the FTC are first investigated to even see if its legitimate, first, before the complaint is lodged by the FTC against the company and the fines are levied.

I keep harping on about filing complaints mainly because IF the complaint is legitimate, griping about it on a discussion board isn't really going to help. Politics/law/etc., as someone mentioned on another post, is all about procedures. And procedures ARE in place to investigate and file complaints on the consumer's behalf.

It's not enough to say "Johnny took my pencil", if you can't PROVE it, you'll end up looking like the schoolyard crybaby. But if you signed a contract with Johnny for a widget in exchange for a pencil, and Johnny already gave you the widget - well, then. Schoolyard baby.

I searched this company in Google before I made my post above and I know they have a wonderful record. Again, it's why I say that if one has a REAL complaint, then file it, file it, file it.
