Gordon & Wong Again....

A man came to my house yesterday and asked if I knew "erik" and then handed me an envelope and walked away. He didn't confirm it was the erik he was looking for, or whether or not erik lived here...he just handed the papers and left.

The I open up the docs to see that we're being sued and G&W are representing a creditor that I have never received anything from, but they do show up on "erik"s credit report...

I called and asked them who they were, and who thier client was representing because I didn't know who either of them were. And all he would say was that it was a department store card but wouldn't verify where the debt came from. And their client who I also called said they had no info because the file was with an attoryney's office.

The documents were a summons, and we apparently have 30 days from service (which was done improperly) to respond ...I don't know...go to court? arbitrate? I don't know and all they want us to do is pay 55% of the debt by friday (day after tomorrow) or then the settlement goes up to 65% and if we keep stalling they say they'll get a judgement for the full amount.

The sound totally uneducated, they sounded like a cutrate collection agency...but with the court filings...we don't know what to do...

Has anyone had dealings like this with these people or have any advice on how to handle them?


my wife had a acct with a credit union,which is now in the hands of gordon and wong.would like to get more info on these people.are they really a law firm.believe they are located in the bay area of california.does a dv letter also apply to them?

Well I would assume it was improper because it's supposed to be a "personal service" to the defendant...and the server not only didn't even confirm that the defendant actually lived where he was leaving papers but he didn't even confirm that we knew the defendant.

And no.....I'm not erik...hence the questions regarding improper service.

they probably got their "legal degree" via the internet. Let them go ahead and do what they can but counterstrike at every move, answer every letter and summons and ensure they dont' win by default. But fight to make sure the court knows "erik" was never served.
Trust me, they would NEVER want to get in front of a judge if they are not legitimate.

Depending on what state you live in there is something called "Subsitiute Service" where a person is served via a responsible person at the person place of work or residence and then a copy is mailed to the person at that address.

Just did it in California on a small claim suit I have.

Answer the complaint with the court and request via discovery all the documents that support their claim. IF they don't have them then the case will be dismissed, if they do then make a settlement.
