need help stat

I took out a loan with a payday company they were taking out random other amounts at random dates so I closed my checking accout that I had given them to stop it. They turned me over to a collection agency and are now threatening to hit me up for writing a fraudulent check even though i have paid them $300 more than what I borrowed. Can they do this? Can i get in trouble?


no, debts are civil matters not criminal ones.who was this pdl and who is this bottomfeeder CA?

More the likely they were taking out 'smaller' amounts to ensure your account was still active.
I would make sure your new account is in a different bank.
If they contact you, let them know that they illegally withdrew varying amounts of money from your old account and tell them that is illegal (just to see what they say) and tell them you have your bank statements to back up what you are stating.
And that therefore, you consider your debt to them null and void and if they wish to pursue it, you will sue them.

capitol collections is a bottomfeeder CA.to garnish wages this CA would have to sue you and win.i wouldn't worry about that as any payroll person wouldn't even honor there phone call.go to NACA.NET.there are consumer attorney's in your area that will work on a contingency basis.

Guest, most company (if not all) require a court order to start payroll garnishments.

They are trying to scare you and if they took out more then you owed them, file charges against THEM for theft thru your bank.

Open an account at a totally different bank. Virtually all banks will tell you that if you open a 2nd account with them the "accounts won't be linked in any way".........b.s. They will eventually find the similiar ssn and "link" the account.

Guess there is not end to the depths these scum go to in order to scam people, rightfully so or not............this country has LAWS and ways to go about things.
We are trying to promote how to CORRECTLY go about these things and verifiy debts if you don't recognize them.
Bottom feeders don't care........they obviously scare enough people into paying that it is profitable for them to continue.

and btw........payday loan companies are nothing but new age LOAN SHARKS and that is why they are illegal in most states and they run back under their rocks when you let them know that YOU know your rights and once they provide proof of the debt, you will contact them.

If they don't like it, they can crawl back under their rock.

My HR depatment which is for a large medical facility and has been around a long time did actually give them fax information to send a salary request to had I not called my hr first I am pretty sure they would've gotten the information my work is checking into this because the letterhead from Capital Collections said from the Law office of Capital Collections in Florida when they told me they were in Missippi. what to do
