I defaulted on a few online pay day loans 6 months ago. I can't seem to figure out what to do to clean up the mess. Unfortunately at this time they have been sold off to shady agencies. I have paid a load of fees from the loan interest to bank NSF fees. My checking account charged off at a ending balance of $2k with BofA. Can I talk to the bank and make some arrangement w/them? They couldn't stop the every other day debits that caused the NSF fees because I had to give them proof that arrangments were made w/these pay day places. PLEASE ANY HELP or suggestions. Here is the list of the pay day companies...I reside in OREGON.

**CASH NET USA-sold off to PN Financial-threatening civil court
**ARROW HEAD-sold to National Credit Adjusters-asking for a settlement
**Debt Doctor-sold to National Credit Adjusters-wired them a payment 2/17, but no confirmation
**Loan Point-status unknown
**VC Funding Tran-status unknown

I actually paid some of the companies that I had fell back on. List below. I think I even overpaid some of them.
**LOAN SHOP-Paid the amount I borrowed
**Nation Wide-Paid them $500 on a $300 loan
**One Click Cash-Paid them $500 on a $300 loan
**CASH TRANSFER CENTERS-Garnished my wages $500 on a $300 loan

Can someone just tell me what I need to do to protect myself? Some of these defaulted loans are under shady agencies that are threatening me w/law suits and so on. I know there's nothing they can do except harrass me. HOW DO I GET THEM OFF MY BACK?

I don't think Loan Point is legal either. You really need to review the link I left you on how to deal with illegal lenders, it will give you step by step instructions on how to deal with these illegal lenders. CashNetUSA is legal, so you will need to make payment arrangements with them. The garnishment of your wages can be lifted, unless it was court ordered which I rather doubt. It was probably a wage assignment you signed when you obtained the loan, all you will need to do is send them an email revoking thier right to do a wage assignment on you, show it to your employer, then they MUST STOP taking money out of your wages to send to this lender, it is the law!

Click on the link below, it will describe how wage assignments work, you can print it out and show it to your employer, but first you need to send an email to this lender and revoke their rights for the wage assignment, print out the email and show it to your employer along with the article at the link below.

It's funny that 2 different agencies are coming after me for the Cash Net debt. I even called Cash Net and they told me to play phone tag w/all the places it's been sold off to. My balance is $243 and Tri Financial wants $900 and PN Financial wants $1000. PN Financial sent me a generic letter demanding for payment by Feb 23rd. I don't think any right collector would leave me voice mails mentioning about court, law suits, blah. Both companies seem fishy to me. Plz note I have proof showing that I have been a customer to Cash Net since 2006! Can you imagine all that money they made off me.

The garnishment has been paid in full. I won't try to fight for the money back. I have too much going on. Right now I want to focus on the link you sent me and also what to do w/Cash Net and even my charge off BofA checking account. I can't even open a account anywhere anymore. Any suggestions on that?

I know what you're saying, unfortunately CashNetUSA operates legally and not as a pdl, but usually as a CSO (Credit Service Organization), which means they are not regulated and can charge any amount of interest they want. It seems unfair but until the Feds jump in and regulate them, people need to avoid them altogether. But that doesn't help you now so let's focus on that. Did you receive a dunning letter from either of these collection agencies? A dunning letter is a bill required by the FDCPA stating the amount you owe, and stating that you have 30 days to dispute the debt.

I have been hearing a lot of complaints about BOA lately from the members here, it seems they are not very helpful and charge excessive amounts of money for overdrawn accounts. The only suggestion I can give you is to look at the banking section of this forum, there are banks listed that do not use chexysystems and are easier to get accounts with. The only other thing you can do is file a complaint with the FTC about BOA and the way they mishandled your account, I would also write complaint letters to the Branch Manger of the BOA where you held your account.

Both companies have caught my attention by leaving me vmails stating that a civil case will be ordered against me. **Tri Financial has NEVER sent me any correspondence except a email confirming payment arrangement. Which didn't fall through because I so happened to lose my debit card. All of a sudden **PN Financial steps in and left vmails on my cell and work #. I actually got a very generic letter in the mail showing "FINAL NOTICE". Here's a insert from the letter, "Be advised that by Feb 23rd if you have not accepted our terms and conditions, we will have exhausted all voluntary methods of resolution. Our intentions are to seek whatever legal remedies are avail. Additionally you are cautioned that unless this balance is paid, our office will execute all interest, legal fees, and/or penalties allowable under the terms of the original contract in accordance with the state laws in which you reside."
Okay...I have seen collection letters from like Wells Fargo before and they normally have this break down that you have 30 days blah blah. This letter is dated 2/12/09 and a payment is demanded by2/23/09.
Yes these CSO's need to be regulated!!
