I'm back... Loan from 2005 possibly back to haunt me?

They told me I have a payday loan in my name from 2005 through Fast Cash and I have to pay $600.xx or they will file judgement. I told her I refuse to pay anymore than the original amount borrowed, which would have been $300 or less, since I have never had a loan more than that. She immediately began to negotiate with me and I told her to stop, I would be glad to negotiate with her, but I wanted everything in writing. She got extremely ugly and interrupted me, talking over me and not letting me get another word in. She said "Well that's fine. I'll mark in the notes you were hostile and refuse to pay and we'll be filing a judgment against you. Have a great day, goodbye."
Helloooo I never said I wouldn't pay it, but I want it in writing. I want EVERYTHING in writing, I don't trust anyone.
I have a few questions - who are these people and why do my searches turn up nothing? Is it possible they will file a judgement? A few months ago, I took care of PDLs in my husband's name, and those were dropped pretty quickly. Haven't heard hide nor hair of those folks once I sent my letters. Are they bluffing me? What do you think guys? I'm in Louisiana, if that helps.

I am so aggravated - they said they need to verify information to file paperwork on a debt attached to my name and my social security number. I just keep stressing about this, mainly because I can find no info on them whatsoever and they continue to call. Not even a result when I google them - what gives? Anyone know?

My head tells me you are right, I think I'm just stressed because I am working so hard to clean up our credit and we finally have our head above water, the slightest thing right now though could push us back under and I want to avoid that. If it's a PDL (which they said it was) and it's from 2005, I would think they would have sued already if they were serious, right? They said it was through Fast Cash, I don't recall ever having a loan through them. I did have one through Apple around 2005, maybe 2006, but don't recall ever having anything through Fast Cash.

Just remember they are supposed to send you written information 5 business days after first contact. So the next time they call let them know that they have so many days left to get you your written letter or you will file complaints against them. Like Paul said it is a bottom feeder and any legit company will send you a letter.

I'll do you one better---once you discover for certain who they are, you have grounds to sue THEM. There is no such thing as "we're going to file a judgment on you"......a judgment only happens once a lawsuit is filed against you and a judge determines that the plaintiff has proven its case against you. They cannot "file a judgment".....and the fact that they tried to scare you into paying like that shows that they are bottom-feeders. No legitimate collection agency woudl use tactics that are that blatantly illegal. The fact that she specifically said "our company handles pre-legal matters for attorneys that file judgments" can also be construed as a violation of the FDCPA on the same grounds--the 'least sophisticated consumer' standard would not allow either of those two statements through in my opinion.
Also, the fact that they left a message on an answering machine specifically saying that they are calling about a debt attached to your name and SSN could also be a violation of the FDCPA, since that is protected information that they are not allowed to make available to any third party without your specific consent. Leaving info like that on a voicemail or answering machine message has gotten other CA's in trouble in the past...

phone harassment is a serious offence. call your phone company and ask for the number to the unlawful call center. they can tell you how to report these calls to them. i believe after you tell them to stop calling, it only takes three calls to be considered harassment and you can prosecute them. worth looking in to.

These people have been calling my dad (at work), my brother (on his cell phone) and me at home. They are telling my brother and I that they are going to supeona us regarding a debt that we are linked to that is in my fathers name. They have also contacted my father but would not give him any information regarding the debt that he owes, only the amount and case number. The woman told him that she did not have the name of the company that had hired them to collect the debt. Now they have called me. Seriously I know that they cannot request that neither my brother or me pay on anything that we never signed our names to and anyone who is a legit CA would have the name of the company that owns the debt. These people try to use backhanded intimidation to trick people to pay money they don't owe.

I just got off the phone with a lady at this company stating that I owe a loan to a PDL. She gave me the name of the company and tried to give me all the information pertaining to me. However she was not willing to send me anything showing that I had gotten the loan, only that she was going to file a judgement aganist me if I didn't pay the money they said I owed. This is BS. If I suppose to owe a debt, why can't you provide me with details in writing?

They are looking for personal info to further their collection efforts. If you have not received a dunning letter from them within 5 days of their initial contact, then I would not talk to them again. If you got the dunning letter, then send a DV letter to the address on the letterhead. Whatever you do, do not let them bully you. All they can do is call. They cannot have you arrested, have you fired from your job, take your driver's license away, or freeze your ssn. (Some collectors use all of these threats).
Make them prove the debt is yours, and they have the right to collect it.

they will not file a court claim for such low amounts. it costs them too much money in court costs and time fo ging to court. also if they refuse to give you any information in writing or rquest info from you its bogus. how can someone recover money and not have any info other than your name and a supposed debt. dont fal for it. also look up your statuate of limitations for your state to recover a debt. sometimes they will say the debt is say 6 years old or so and the statuate in your state may only be 4 years to recover you can use that against them. California the period is 4 years, other states have different time frames.

I spoke with two people at this company. One whom went by Eddie and another whom went by Rick Aceto. Neither were willing to substantiate the bill by mailing me a written copy. They also did not have my correct address or an address that I have resided in the past at. They had my mothers address which concerned me even more. They also threatened to take me to court to garnish my wages and insisted that I give them a credit card number over the phone stating they would not accept a check by mail. They insisted that they have made several attempts to reach me by mail, in which I have never received accept the harassing phone calls. I feel their practices are highly unprofessional and threatening. I also find it odd that they would not allow me to review documentation about the alleged debt.
I would just like for consumers to be aware of this business as I feel they are illegitimately attempting to get consumers' money. Also, I just completed a complaint form with the BBB as I am highly concerned this company is taking advantage of people.
