Speedy-Paydayloan and e-payday-loan
Date: Thu, 02/19/2009 - 17:57
I have made one payment to Speedy in the amount of $130 on a $390 balance. Here's the problem-I mailed in a money order and about 2 weeks later got a reminder email. I called and talked to "Ms. Cashmere" who evidently is THE collections department. She said that the email was automatically generated, but the "managers" had not posted the payment yet, and she would check on it and let me know. That has been over 2 weeks ago and each time I call, I speak with her and get the same story. They are not calling or hounding me, but the 2nd payment is coming up and I really want credit for the 1st before I send another. Has anyone had this situation with them?
The second situation is a bit more of a problem. After a VERY heated discussion with e-payday I finally asked if they were licensed and was told "Oh, there you go with that licensing stuff". We went around and around and finally they said they would "accept" two $280 payments to pay the account in full. This amount includes the original amount, the 3rd fee, which I stopped payment on and the fee for February. This is on a loan with an original balance of $350, on which I have made 2 $105 payments and one payment that was returned.
I believe from the forum that e-payday is illegal in Tennessee. Is this correct? I originally did not want to close my account, but have now changed banks and they do not have my new info. I need some advice, should I suck it up and pay their payments so the phone calls don't start, or pay the principal amount I owe, which is actually $140.00? BTW-when I originally spoke with them, I offered to settle for $275, which was one fee, plus the $140 principal remaining and the returned payment charge-I thought this was more than fair. I NEVER received any paperwork from them-despite requesting it on the phone and by email several times. Honestly, I don't remember even e-signing anything at all.
Any advice??

did you get either payment plan in writing?in the case of e-payday i wouldn't give them a dime without something in writing.e-payday is illegal therefore you only owe the 140.00.again give them nothing without something in writing.file AG complaints.the reason these illegals call repeatedly is so you do pay more than you should.stick to your guns.they can't do anything but call.

I did not get anything in writing from them. So in the case of Speedy-would you send another money order and hope they eventually get posted? I do have a receipt and the fax I sent them of the copy of the money order, which they acknowledge receiving. They are very nice when I call-maybe I'm just being paranoid? I think they are a legal lender, correct?
As for e-payday - since they do not have my current account info., should I just make a $140 payment and let it go? They refused to give any way to send a money order-insisting on pre-paid debit. I guess I could call and ask for a way to make a western union payment and then just send the $140 along with emailing and mailing a cease and desist letter and see what happens?
They have not called at all since I had the payment stopped and we had a phone battle and they had not debited my old account again.

What do you mean when you say forget about Speedy? Meaning don't pay them anything else or just pay and don't worry about the payment not being posted? It was my understanding they are legal and I just wanted to pay them fairly.
Thanks!

Sorry-I misread it as FORGET about speedy! I'll try to find another number for Speedy or maybe speak to one of the "managers".
I really do not think I will get ANYTHING in writing from e-payday-they were absolutely ridiculous when I spoke with them. I forgot about this part-after we initially settled on $455, they called BACK with the total of $560 because their managers would not excuse the February fee.
I kinda got the impression though, that it was because they thought since I had caved on the $455 they would go ahead and see what else they could get. OK-so if I go ahead and send only the $140, besides the cease and desist what else do I need to do? Do they usually just accept what they can get or continue to harass?

They could have cashed it and not applied it.

OK-so I finally got through to Speedy-PaydayLoan yesterday and their customer service would not give me any information. They referred me to collections again-I have been calling and leaving repeated messages but get no response. I called customer service again today and asked them to see if a payment had been applied (I sent a money order that has not been posted). The agent said he did not see any notes on the account. I asked for the balance and he said, "well, I'm not sure I should say-there are two balances one that is the amount owed and then one that is the balance". What does this mean? I called MoneyGram and they say the Money Order has not been cashed.
I mailed this on Jan. 30 to the address and with the instructions that were provided. Has anyone else experienced this situation with Speedy or any others? I can't double up the payment this month while I wait for a refund and I will not pay any more than the amount we agreed on.
Any suggestions??

I am starting to think Speedy is illegal.
I would not send any more money until the first payment is noted.

I overpaid Speedy by $870 and when I sent them a certified letter requesting a paid in full and a refund they issued me a refund for $870. I was shocked!!!!! They have not sent me anything saying that I'm paid in full so I requested that information from them again. I made copies of the check they issued to me and kept the envelope it was sent in with all of their information on the outside of it. I know they are illegal and if you dig up information on them you will find that aren't even supposed to be lending anymore.

Another strange twist to this story. I got ahold of the "collections department" for Speedy today. They claim now that they DO have the payment and gave me the new balance which is correct if you count the last payment. I repeated to the lady what I was told yesterday and she said the customer service agents don't know what is going on, they just see what is in the computer. I still could not find out what exactly WAS in the computer, though.
Anyway, I guess I will send in another payment tomorrow, but am really beginning to question the way this has been handled. I'm not sure where the Money Order is, and as long as they are crediting my account, I guess I don't care, but it is kinda strange.

Have them send you an email stating your new balance. That way you have it in writing. I would not trust just their word since you confirmed the MO had not been cashed.

Good News! I actually got an email today showing the amount of the payment made and my new balance. I went ahead and purchased another money order for my next payment, as all seems OK. Almost done with this one!

OK-so I emailed letter today to e-payday with terms under which I would pay, revoking (again) ACH, wage assignment, no calls, etc. and gave them debit card # for amount I owe (principal only), with the directions that it would only be valid today. Nothing. I didn't get a return email, no acknowledgement, and the card has not been charged.
Any suggestions?

You gave them the debit card number in an email?
Not sure if that was a good idea but if all you have on it is the amount you owe them you are okay.
If they take the money then I assume that makes the terms of the pay off settled clear, which is probably why they have not taken it. They want to hold out for more.

Sorry-I should have clarified-it is a prepaid debit card with only the amount I owe on it. BTW-how long would you wait to see if they charge the card? Also, as they are illegal, if they do not want to accept this, what might the next step be?
I was told if I did not agree to their terms it would be placed with an outside agency.

If they are illegal then the outside agency will most likely be illegal as well.
I would wait a day or so. Sometimes it does take awhile for the illegals to do anything.
I swear they need to go on google and translate what you have written before they come back with their canned letter.

Update-heard from e-payday-loan today. First I got a threatening message on my cell phone asking didn't I care about my credit-this would stay 7 years, more fees would be added, etc. I resent the email I sent two days ago. When I heard back, they "offered" to let me pay $350, which was the amount of the original loan. Said the offer was good for today only. I have paid $210 on this loan already. Went back and forth by email, I finally "offered" $245, which is $140 for remainder of principal, plus one fee. Heard nothing else since then. I feel that the amount I offered is more than fair.
Anyone else dealt with them and have any suggestions?

I have dealt with them and they are horrible!!!!! They took me for over $2,500 and would not give me a refund and they were terribly rude to me on the phone. They didn't pursue anything from me because they KNOW I well overpaid them but when I asked for a refund the man I spoke to said good luck and hung up on me. They are illegal so I would only pay the principal balance of your loan with them. Don't let them scare you and don't give them more than you owe them.

Tenn1, as far as credit, if they put it on your report dispute it. I did with trans union and they deleted it off my report. So the whole "7" years thing is full of crap.
