I set up a payment plan with Mann Bracken and have not received anything in writing. I hate them..they are the scum of the Earth. The representative I spoke to said a letter will be sent before the funds are withdrawn. I have yet to receive it. I'm upset I gave them my banking information I'm afraid they are going to take out more in the future. So far they have deducted the first payment. I set up the payment arrangement thinking this will delay or dismiss the arbitration as the rep said on the phone. I called her a 2nd time when I received the 2nd arbitration notice and she stated Chase still wants their money the arbitration will proceed. I'm furious that I gave my banking information and now the arbitration process has begun despite already setting up a payment plan. I'm nervous and don't know what to do. I think it's illegal for me to record phone calls in New York. I feel I'm stuck. I'm unemployed and am afraid they are going to take all of my money from unemployment insurance. Should I send a letter stating they are able to withdraw the 6 payments I authorized but afterwards the payments will be made via money order or certified check?

Thanks. I've read most of those links prior to my post. I'm just upset that I already have a payment plan set up with them. I feel they are trying to scam me and it's very upseting. I wish I could stop the payments and send a letter to them stating you are not complying with the terms agreed upon until I receive everything in writing I will not proceed with payments but I feel it's too late for that.

You WILL be screwed with a payment plan and no official statement from the company. Contact your bank immediately and tell them your account numbers have been compromised, hell even dispute the ACH withdraw they made. You have a right to do this as the company can add interest to the amount with telling you, not properly account for your payments, or take payments from you for a few years then sell the debt which will accrue interest and you will be back in this same boat again starting from scratch until they sue. Never ever ever ever ever trust a dirt bag (aka the only miserable guy they could found to work as a collection agent).

I paid on a debt for months with a creditor and had no written official payment plan because I thought I was working with a professional company (national creditors bureau). All $200 payments they took I was then told went to "interest on the delinquent account" and I wasted it all. Bank of America was unwilling to help as they (the debtor) never received the money. Sure I did the FTC, ATTY GENERAL, and BBB thing but no one cares as the government profits off lawsuits. Please take this advice seriously.
