Anyway, last Wednesday I contacted this office to see if they would accept a payment plan that I could afford, which they did. So, this settles going to court. The lady I spoke to said that she would be sending me out some paperwork listing the payment agreement and I have to sign it and send it back with my first payment.
My question is, if I am making my monthly payments as promised and don't default can they be sneaky and freeze my bank account without taking me to court and having the judge order so? I just don't trust these people and have heard some pretty negative things about this office. Thanks!

I just got off the phone with them about an hour ago because I still have not recieved the paperwork to sign and send back before the court date. The lady I spoke with was extremely rude and told me that my court date isn't for another month and to be patient!! She tells me to be patient yet they want their money right away?!? Then she proceded to tell me that my next payment is due 3 days before the end of this month, duuuuuuuh! I think I know that you moron! Then she got all rude again and I hung up on her. These are the rudest people I have ever dealt with!

You should not be making any payments without a written agreement, because they can and probably will deny the agreement was ever reached.
Send them a letter (CMRR) stating what you understand the terms of the settlement to be and that you will not send any payment without a signed agreement from them by a lawyer in the office. Make sure the name is printed on the document along with the signature. I have seen letter with just a signature which can later said to be a nonauthorized agent.
Once you get the letter, check your states BAR registry and make sure that the person is a lawyer and legally able to practice law in your state.

I totally agree with not sending any payments until you have this agreement in writing. It is one thing this site has taught us is to make sure you have it in writing.
