Academy Collection-anyone been sued by them?
Date: Mon, 02/23/2009 - 14:46
I am wondering if anyone here has actually been sued by Academy, I know they threaten it all the time but have they ever followed through on those threats?
If so, did you go to court, what happened?
I'm sure one day I will get served and would like to know what I need to do or what someone else did successfully with them in the past.
I am in Minnesota too, don't know if that changes things.
Also, in MN, if a creditor does win a judgement can they come take your possessions to auction for a credit card debt?
Thanks.
Have you sent a debt validation letter to Academy Collections?

For 20K you are definitely looking to be in a civil suit and more than likely they will press forward on the suit and ignore your DV letter. Not uncommon at all......collection lawyers are literally dirty animals. Make sure you show in court as you never know if they will have the contract with them or not. Request to see it!

Hi Phoenix,
I did not send a debt validation letter. they aren't calling me anymore so I am not sure if they still own the account or not. Should I still send it to them or wait it out?
On a much happier not...the sheriff detective that was looking for me was actually a good thing. It was about a process server that lied and said he served me but did not. The law firm that originally won a default judgement had to vacate the judgement because of it so he was just looking to get proof from me that I did not get served. Phew.
Anyways....let me know if I should still contact Academy for a debt validation or sit back and wait.
Thanks for the help!
BTW...the last post was me...I thought I was logged in.

Hi Freeme,
Academy Collections was just forced by the FTC to pay $2.25 million for FDCPA violations, so that could be the reason.
Yet another reason to get documentation of collector abuse and file proper complaints with the FTC and your State Attorney General's office.
Definitely send the letters just in case. Certified Mail, Return Receipt Requested.
Or they may have passed it on to another collection agency, which you'll be hearing from very soon.
Keep us posted.
