ACE Payday Defaulted Loan- I need help

I am currently dealing with ACE in Texas on a defaulted loan. I have made several attempts to make payment arrangements with them. However, they will never accept them. I am told they will only accept the full amount. However, just last week a Ms. Berkins called me saying that I could have been making payments this whole time. She said that for the first 90 days they have to accept any payment I make. Now, she can’t do anything to help me(its been since October when loan defaulted). Also, she said that since I work for the city I will be fired from my job since they do not allow their employees to have bad checks. She also said she has listened to all of my conversations I have had. I replied back to her that if she heard my conversations then she knows I have asked to make payments but I was told I couldn’t by Ace’s people. She said that she didn’t know what tactics the people down here have used with me but that was not correct. I also told her that I have made several attempts to contact them and have not hidden from them in order to resolve this issue. But no one will work with me.
I told her I could do a certain amount this past Saturday. I went to the store to make the payment the woman at the store could not find my case under my name. It was under someone else’s name even my social security number. So, yesterday I called Ms. Berkins at Ace’s office and told her what happened. She said the woman was looking at the wrong screen and she called the store and walked her through it. So, I told her I would try to make it in last night after work. I couldn’t make it. Then late last night another woman, Ms. Cox, called yelling at me. Told me I was a liar, I was an unworthy person, and I never intended to pay anything. I told her that Ms. Berkins verified that I did attempt the payment since I had given her the store locations number. She said she did not care and she was going to file against me. Also, she would contact my job. She said I was doing this because I did not want to be embarrassed at work. However, in the same breath she said I just did not care and was never going to do anything about it. I tried to respond to her by saying if I did not care, if I was not trying to resolve this issue, I would have not called them on my own nor would I care if she spoke to my boss. Also, again she said I was a liar. She also said that Ms. Berkins evidently saw something in me to accept the payment I was trying to make but she saw nothing in me. So, she could care less what happened to me. Every time I would try to say something she would say she didn’t want to hear what I had to say. Eventually she hung up on me. The last thing she said to me was that I had until 12pm today to make a $300 payment.
I don’t have the $300, I can make a portion of that payment. But that’s it for now. I’m at a loss. I do not know what to do. I talked to an attorney, not sure if it’s a good one, but she said to ride it out. However, I don’t know what Ms. Berkins nor Ms Cox means when they say they need to contact my boss to confirm when I will be at work. I told them I work these hours and this is when I will be there. I said they can confirm it with my boss. They never responded to that either. I was very upset that Ms. Berkins informed that I could have been making payments this whole time because this would have been resolved in December. Bottomline, I am so depressed about this, I have not stopped crying for fear of what they are going to do to me. I don’t know if they want to arrest me for the check or if they are going to sue me. Any advice will be greatly appreciated. I will be contacting the Tx. Consumer Credit Commissioner and FTC for help. Who knows if they can or not. They basically have broken me down to the point where I have not been able to stop crying and just don’t know what to do. I have made several attempts to take care of it but they won’t accept it. That is what has me upset the most I suppose because I know I have tried. Thank you in advance for advice!

Ok Ace is a legal licensed lender and most likely a CSO in Texas. I would go back to that store front and make the payment that you promised to make the other day. Hopefully they will accept it. Make sure you get a receipt and keep it.
Any payment you make will show good faith. Debt is a civil matter not criminal so keep making payments as often as possible. If they would decide to file a judgment against you you can probably have this paid off before it would go to court.
You are not going to lose your job. If it would come up just state to your boss that you had fraudulent activity on your bank account and had to close it and you are working on other payment arrangments with your creditors.

Sounds good. As we call it in our job "effort/ good faith to repay" will mitigate in any court room. Try and make a payment then work on establishing a repayment plan for the remainder of the balance. best of Luck! :wink:

Thank you all very much for your answers!!! I appreciate it so much! Here is an update, I made a payment at the store and called it in to Ms. Berkins. She was not happy and continued to dig into me about not paying it off. She said this matter was going to be filed against me along with all the conversations I have had since they recorded them. I said, ???Wonderful! Then whoever it is you will be giving my case to will hear how often I requested to make payments and all of you said ???No??? to me??? That made her even more upset- she told me I was done and hung up on me.
I contacted the Texas Credit Consumer Commissioner who informed me they were protected by the CSO. The woman was so nice and let me explain my situation to her. She guided me to the CSO site and pointed out their FAQS to me. I looked at their website where it clearly states they are not to threaten criminal action or use abuse when trying to collect on a defaulted loan. (Sorry, I can not paste it here now. I will soon for others.)
I made my company aware of the situation using your advice. I was assured all would be fine and I had nothing to worry about. Thank GOD! Yes, it does seem as long as I go into the store to make any payments they will accept it. The gentleman at the store did not say I couldn???t not make a payment for less than what I have been told from ACE.
I will continue to attempt the payments as long as they will accept them at the store. If anything should change or I have any info to share I will definitely post.
