Can a DV be sent after a summons was served??

Just received a summons yesturday being sued by Capital One. I live in Colorado. Account was charged off and collection agency MRS Assoc sent a few letters in 2008(dummie, I ignored them) then at the end of 12/08 attorney Linebarger goggan blair sampson sent a "Notice of Debt" letter stating unless in 30 days I dispute this debt etc.(dummie, I ignored it, too) Now the attorney on the summons is Machol & Johannes with the same exact address as Linebarger Goggan Blair Sampson.
Should I send the validation letter and wait to file an answer to see if I get anything back? Summons says I need to file an answer or show up on April 14th, 2009? Confused?


SOL in CO is 6 years so you are well w/in SOL. Start researching CO's Rules of Civil Procedure to familiarize yourself with the courts rules

That is correct. Did you recieve anything else with the Summons? The complaint? Interrogatories, Request for Production of Documents, an affadavit? If so, you can use those as a roadmap to draw up your own set of Interrogatories and requests for POD.

She really is a idiot junior attorney...I beat her pro se and now she has to pay me because I counter sued. She is from Javitch, Block & Rathbone...
