do you have any money saved? alot of times they want the full amount up front. but not always i have heard of settled payment plans.
this is my suggestion call them tell them that you just came into some money and you can pay them right now x dollars to settle it and have it gone. this amount is usually about 50% of the debt and see what they say. they may counter offer thats why alot of people from what i hear start low at more like 30% of the debt so that when they counter offer it will be around 50%.
I would not tell them that you have a good income or they may expect you to pay it in full scince you now have a good income. Maybe tell them you want to pay it with a refund or something.

It is ALWAYS a good idea to try to settle before your court date. Call the attorneys representing the plaintiff, and tell them you want to work out a settlement. I too would not let them know you have a good income; instead, let them know why you fell behind, how hard it is for you, etc. and tell them either what amount you currently have available to pay in one lump sum with, or if you don't have a lump sum, that you would like some sort of monthly arrangement. There is an excellent chance this will happen. You may still have to go to court, but only to assert that the case has been dismissed. You will get a signed document called ORDER TO DISMISS WITH LEAVE TO REINSTATE. That means for all intents and purposes the case is dismissed but can be reopened if you do not stick with the repayment plan or start missing payments. It is standard operating procedure, and will not go as a judgement against you. You have a couple of weeks to work on it with the attorneys, to barter back and forth.
I agree with Susie. Its better to settle before the court date.
I agree with Susie. Its better to settle before the court date. But if the settlement didn't materialize then do answer summon.

I have contacted the attorneys representing the plantiff. She offered me 30% discount on $14,000 and asked me to set up monthly payment. She asked me downpayment about $2,000 and I told her to find me a better offer. She told me that she will contact Amex to see if there is better offer. DO you have any advice in this situation? I told her that I could pay $1,000 this month and next month then go with monthly payment. I hope to get better discount than 30%. Thanks for your advice!

I have contacted the company again and they told me my account has been dismissed and asked me to contact Amex if I want to settle. They told me the plantiff is also dimissed and I don't have to go to court. Do you have any idea in this case? I don't know why Amex has dismissed my debt or account or my case. Anyway, I don't need to go to court next week and I will try to find the way out of debt. Thanks

mijiking,
Have you checked with the courts to make sure the case is indeed canceled? You don't want to get duped by not going to court and then have them show up and get a judgment on you.
I would go to court (if it's a real summons) and ensure that the case is indeed dropped.
I have called the court and they said my case is not dismissed.
I have called the court and they said my case is not dismissed. Then, I have called the attorney and they told me my case will be dismissed on the sermon date. They said I don't have to go to court. Does anybody have idea? Are they going to piss me off if I don't show up? I think I'd better to be there to make sure my case is dismissed on that date. Thanks for your advice!
It's been about 2 years. Anybody has idea if there is a sermon?

What should I have to tell or not to tell?
Thanks!

Make sure you show up for that court date. Sounds like they are trying to trick you. If it is dismissed you can go home. If it isn't they may give you a lower settlement before actually going in to see the judge.

i would surely show up for cout i do agree that they may be tricking you too. If you dont show up they get a automatic judgement. Unless you recieve something from the actual court saying its dismissed dont believe it. be sure to be there.

I've been to the court today and my case wasnot called and Judge asked if there is anybody come here and didn't here the case call at the last. I came up to Judge and he checked my case number. He told me my case is dissmissed and asked me to check with court atterney to see why this case is dismissed. Court atterney told me my account has been dismissed by Amex. He told me I am lucky. Thanks for all the comments and I wasnot nervous at the court because of all the people here. I saw many cases people didn't show up and the case has been judged as a default. And all the cases with people show up brought to further negociation for 60 days. I also recommend people to show up to the court and don't worry anything. Judge will give them time to negociate with CC company. Thanks and have a nice weekend!

the judge that i had was very compationate. I tell everyone that. Everyone is fearful of judgement but once it happens once they see that long list of others on that clip board. Now consider that is just one day. People are in trouble and in my case the judge was angry that a decision could not be made outside of the court.
judgement is not as bad as it seems at the time. It seems scary, but once you go through it once, its not as bad as you think. It is very important that you do show up. Because if you dont, and they dont, they still win and you loose. If you show up you atleast have a fighting chance. If you dont show up you automaticly loose.
