Payday loan in Texas

In December 2008 I took a payday loan out from Ace Cash Express in Houston, Texas in the amount of $1100 and ran into a situation where I was unable to pay the debt and put a stop payment on any drafts from that company. Today I received a phone call from them and was informed that they would contact my employer and inform them of my debt they would file and civil suit, take my paycheck and I would go to jail if I don't pay this debt. Also they informed me that because my employers corporate office was in Tennessee and not in Texas where I reside that the same laws do not pertain to my payday loan. I can now begin paying on this debt and informed her that I would pay $100 tommorrow and she informed me that that would show good faith. I am now scared that I may go to jail or lose my job. I want to pay the loan back but I don't want to live in fear while doing so. HELP!


A creditor can never contact your employer directly and garnish your wages. For garnishing you wage, the creditor must sue you to the court and bring judgment against you to recover the debt. You need not fear of going to jail just because you could not pay back the debt on time. However, before you pay them off, you should get the terms and conditions of the repayment agreement in writing.

hi i have had one also from ACE in houston too i defaulted on it. and this guy MR WILL'S called me threating that he was going to put a hold on my dl and ss# and that he would make my life a living hell if i did not pay!. so i was scared to death well let me tell you they CANT I REPEAT CANT do anything to you all they can do is send it to a 3rd party collection agency i spoke with a lawyer in houston that deals with payday loan com[panys and she told me to record the phone call next time. DONT worry ... that guy stated he was an investorgater and was caling to get my statement before he filled a bad check agaisnt me. 1st of all he was not an investorgiator i called and found out he was a account manager for ace out of irving texas. so pleaseeeeeee dont worry about thease people pay them when you can. just relax everytrhing will be ok.

I to havce a loan with Ace and they treated to take my wages and send me to jail. I want to pay this off but they will not work woth me what can I do help.......

Yes I am serious.

The only thing they can do is take you to civil court and get a judgement to garnish but in TX that is almost impossible. TX has very strict garnishment laws. They can not have you arrested or sent to jail. Debt is a civil matter not a criminal one.

The harrassment and threats are against the law and they should be reported.

I agree with most of you. I too want to pay of my PDL's, but what about them contacting our employers if we by chance I default or our references? Are you saying by law they can't or shouldn't???

I rec'vd a call from a guy who advised me of a payday loan I had with this MY cASH TYME, I could not re-pay. H e threaten to fille fraud charges.. can they do that ?
